Here is an interesting thought: the acceptable lead rate changes over the first few years. In 2009, items are legal to sell if they have less than 600 parts per million of lead. In 2010, the limit drops to 300 parts per million. So, if it is discovered tomorrow that vintage Joes have, say, 500 parts per million of lead, then they would be legal to sell in 2009, but then become illegal in 2010! Can you imagine the craziness that would ensue? Unfortunatley, this is not the first time Congress has produced legislation with consequences like this (just look at the estate tax laws). |

If a lawyer or someone can state their credentials and honestly give a working American approach, please do so. Don't live in fear. Keep buying your vintage toys. I think the gov is really starting to split hairs on this lead paint crap. We went through the 80s and we LIVED! hell, 600ppm could be floating in the air. Just like we could be huffing toxins just by walking down the street or killing ourselves with food preservatives. I understand the need to set guidelines but how far will it go? |

Here's a tidbit.
Say you decide to test all your vintage product. The law requires that after August all items falling under this law must be done by a third party lab. |

before you guys go fire sale on your old toys and march in the streets, try reading more sources....

this law is more broad and effects more than toys. It affects crayons, cribs, video games etc. economy homeless people.

Enforcement is not really an issue, your not going to see this added to a special group of inspectors or have the Fire Chief come by your store to check your HAZMAT plans in regards to this. What will happen though is so and so customer buys a product, finds out later that it is contaminated, gets a lawyer who sets up one of those nation wide telephone call centers for a class action law suit (if its some big retailer like Walmart). Thats the only enforcmenet I can see coming from it, case by case lawsuits against normal peopl eor small retailers when someone tries to make a fast buck from sueing. This just gives people one more ace in the hole to sue the hell out of someone for failure to comply with government regualtory statuates.

Feel free to read my earlier posts. But I agree with you that everyone should calm down. This is a new law, it hasn't even gone into effect yet. There is no way to tell what sort of enforcement there will be. There is no caselaw interpreting this statute yet either, so just read the text of the law carefully and you will know just as much as any attorney. |
