First, filing a claim is a very serious issue for a seller, and what you were doing is filing a fraudulent claim. What the hell are you asking for? To have an item sent to you for free? Because filing a claim will not force him to accept your money. Second, after he refunded your money and explained the situation to you, you responded by basically calling him a liar. Now what the hell does this solve? If I was in his situation, and I had honestly made a mistake, and you come back and call me a liar, I'd tell you to fuck off too. I don't have it, you can bitch all you want and it won't change things. Now if he is lying, what is calling him a liar going to get you? Still nothing. If anything all it can do is sway whether or not you want to leave bad feedback, which is the only thing you are entitled to in this whole situation. That's actually a pretty powerful thing to have against a seller, and again, shouldn't be used lightly. Ebay is one of the only forums on the planet, where a couple of pissed off buyers can ruin a seller's livelihood.

I do agree that opening a claim may not have been the best option only because there is probably nothing that will come from it. From the previous thread, this member has done this sort of thing before so other than outing him and educating everyone else about his actions, there wasn't a whole lot else to do. That sucks, but if he doesn't have em, he really can't send you anything.
Just be happy he refunded your money fast, and hope you can find another lot.

Whether or not he deserves the negative (which he probably does), I'm pointing out that filing the claim the way he did is poor etiquette on the part of an ebay buyer in all instances. If he did it in this case, maybe he feels it's ok in the next case. The next auction could be yours Lody, and it might not be him, but maybe another tanker who doesn't know it's your account, doesn't believe you, and files a claim. Ebay isn't doing a goddamn thing to educate it's buyers on how much their DSR's and claims kill their sellers. You see it every day on this site. "Some dude screwed me." "Leave negative feedback on him, that'll show him." Feedback doesn't mean jack anymore. Then anytime theirs any issue, file a claim. Even if there isn't a reason to file a claim. But it's ok, ebay will sort it out. Even if they sort it out, you still dinged the crap out of the seller's account, for no valid reason under the claim system. |
