For full disclosure, here is the first message I sent to him, his reply, and my reply to that. In his message he attempts to explain his rationale but he still doesn't make sense in my book. These lead up to the two I've posted above. I guess you're right Joecom, I should make my move and contact customer support again. I'm glad that you guys were able to point out that this is unusual. I would have have been a little lost without your advice. Anyway, here was my first message to him......
"Just looking for shipping confirmation. Usually I would have recieved some sort of e-mail by now (3 business days). I'm not complaining but I am curious as to the status of this item. Please confirm whether or not the item is en route. Thank you for your time in this matter." ....and his reply........ "Sorry for not contacting you sooner, as I meant to. There's an issue with this item that I need to bring to your attention. A few days ago, I went to pack this up and ship it, when I looked very closely at it and saw that the Alpine figure has some noticeable paint slop on its torso that I overlooked when listing it. I assume that Alpine is the main reason you bought this item, as it's the centerpiece of the set, and why most people buy it. So, in good conscience, I couldn't send it to you that way, and frankly, I would expect you to take issue with it. I would, if I were on the receiving end of that. So, I propose we do one of the following two things. If you do not want the item, I can refund your payment in full and we can cancel the transaction. If you do want the item in this more accurately described condition, we will need to refund your payment in full, cancel the first transaction, and then I'll relist it for you at the same price, with a more accurate description of the figure(s). If you want the item, that's the only way it can happen, because the condition needs to be stated correctly in the auction terms. So, please let me know which one you'd like to do. I apologize for the situation, but I don't want you to be unsatisfied with the item." And my reply to him....... "After some thought I've decided that you can go ahead and complete the transaction rather than cancel the order. I contacted Ebay and they explained that the item would not have to be relisted. Your explaination of the condition of the figure is good enough for me and would merit an accurate description in my opinion. I still want the figures despite a paint spot on Alpine. In other words, I certainly won't give you a negative rating based on any of this considering that you've acted in the buyers best interest. Again, thank you for your time and feel free to contact me regarding the transaction." I might give him til tomorrow in the hopes that he actually ships or replies. But I'm not liking our exchanges so far. |

Yep by tomorrow if seller does not give you a clear answer as in Shipping it out! he needs to be reported because now he is breaking the contract as you have stated clearly you want the item and if he is not willing to ship it out then he is up to something and what ever it may be it's not right.

Yeah, I guess that's what I'll try to do. It's frusterating. I'm attempting to be civil with him, but also clear with him. So far he's broken quite a few of the ebay guidelines. I don't want to advertise his name yet, I guess because for some stupid reason I'm still giving him the benifit of the doubt. Anyways, time will tell.

My advice: Just cancel the transaction and move on...
Here's the thing. I work for a power seller, and problems happen all the time (esp for higher volume sellers). If the seller asks to cancel, it's easier to just cancel and get a refund (some seller's won't even go that route (at least you were updated on a problem before finding it yourself). I would just say, "send my refund, then send a cancellation request and I'll accept (in that order). Then just avoid that seller... Seems a problem occurred post sale (this can happen to anyone). Seems to me, even though he's late to answer, he is just trying (in the best way possible) to cancel the transaction due to the description error. Despite your eBay live advice (and you telling the seller that he was safe from a negative), you as a buyer can still go ahead and leave a negative, and still open a not received dispute, or if the figure is horrible (a not as described dispute) so on (as sellers have zero protection). The modern seller is almost like an abused pet, always trying to avoid getting hit. But... If you want to go the easy route, just leave a negative, then post an item not received dispute on Paypal as the Seller can not leave a Negative.... I'd just cancel and ask for a refund... |

Ebay totally gives the buyer the upper hand. As a seller you cannot give the buyer negative feedback. If there is a paint "problem" and you are unhappy, then your able to file a "significantly not as described" complaint. In that case you send the item back, but the buyer is out the initial shipping and actually pays the cost of shipping for you to buy the item. They lose that money. It seems he is trying to protect himself from negative feedback, and also from paying the shipping charges he is out for the item not matching the original description. Ebay does not look at personal messages. They simply look at the listing and all the information provided in the resolution center. I feel he is really just trying to make the transaction work. Ebay is making it nearly impossible to sell. They almost 100 percent believe the buyer. So the seller would always pay for the items shipping and lose that money no matter what if there is a problem.

but, did you buy the item for $54.99. Cause after reading that part it does seem pretty messed up. Canceling a transaction and then re-opening it up for bidding does not seem right. He should just offer a buy it now to you for the selling price with the correct description. Not reopen up bidding on it. I would open up a dispute
