What's this I read about having only 30 days to file a Paypal claim? What if the seller specified that it would take 14-18 working days plus 3 handling days for the item to ship? Coz it comes from China.

Yeah he does state that. He says he would cancel other bids and end it early. It just doesn't make sense to me. So Paypal will refund that quickly eh? Refunding isn't that much of a hassle?
If that's the route I go, I'll ask him to do a buy it now option. That make slightly more sense to me. Either way, I'm still a little confused by his proposal. |

if thats the price you got, ive got an extra one that I dont want boxed(dont worry no excess paint applications) i will sell for 50 plus shipping. If you get your problems worked out with the one on ebay

Ask the seller to send you a more detailed picture of the Alpine figure so you can be better informed.

If both parties cancel it, it can be put up again for grabs to the highest bidder. Personal messages will not, and im pretty sure can't be looked at by ebay. So it seems he didn't get a good price or for whatever reason didnt feel good about the transaction. I know it sucks, but thats ebay. I have been upset about ebay as a buyer and as a seller. But there are also many more occasions that I have got some good deals.

This is the first time I've had a problem ith Ebay and I've been on there for about a year. Either way, I'll keeping using it.

Well, he responded in a to part message. Here it is.
"Dear belhorn77, This morning, in response to this message and your last message, I called eBay to see what they have to say, and what they recommend I do with this particular transaction. I explained what your experience was with the live chat, and they said that didn't sound right. I explained what I outlined doing, and they said that is the proper way to handle it, and that if the buyer didn't want to do that, well, do exactly as I proposed from the start, which is refund the payment and cancel the transaction. And if you wanted the item in its accurate condition, to relist it and you can win it (but they didn't comment on me relisting the auction specifically for you, but this would not be a problem as far as I can imagine). They also stated that this transcript of messages back and forth would, in fact, not be acceptable proof that you agreed to accept the figure(s) in a condition different as decribed in the auction. That is, I would not be covered if you had a problem with them, which I believe you could (I would, in your shoes). So, no, I will not be shipping you a set whose package condition is accurately described, but whose contents are not. The centerpiece figure is not in the condition stated in the auction, and being the ethical seller that I am, I can not ship it to you in lesser condition than it was stated as being and sold as. I am at a loss for words as to why, if you want the set in its real, accurate condition, which is lesser than stated in the auction, you are not willing to cooperate, so that everything is reflected in the transaction record as accurately as possible. It seems, frankly, suspicious. And, I am not "honoring our agreement," because I simply can not. It's not possible. You bid on and won a set that is not described as having an Alpine figure with paint slop on it. We agreed on you getting a figure set with some package damage, as described in the auction, with mint, issue-free contents (figures, etc). PART TWO It's my error in overlooking the condition of the Alpine figure, so I can not live up to the agreement. The agreement, or contract, as it were, is for you to pay the amount of your winning bid plus stated shipping and handling charges, with a PayPal-Confirmed Mailing Address within 24 hours of auction's end. You did your part. My part of the contract is to ship the item in a reasonable amount of time, in the condition stated in the auction. It is physically impossible for me to deliver the item in the condition stated in the auction, because the item is not in the condition stated in the auction. It is markedly, significantly different. It is the ethical thing for me, when I noticed this, to bring it to your attention and attempt to work it out amicably. The fair, reasonable, and right way to do this is to do it the way I've proposed, so that it is on the record what the condition of the item is, so that we're both covered and on a level playing field with this transaction. It is unfortunate that I can not live up to our "agreement," but the reality of the situation is, that I can not. Our agreement is outlined above, and it consists of our responsibilities as seller and buyer in the transaction. I can not live up to the "agreement" as laid out, due to the condition of the item being in lesser condition than stated. That was my oversight. I am offering to sell it to you in the manner I've outlined with the correct condition stated. I'm not looking to make a penny more off this transaction, it just needs to be executed correctly. So, I reiterate: Would you like to purchase this item under the conditions I outlined, in that I relist it with the correct condition of the item described in the auction, for the same price you paid for it ($54.99 plus $9.99 shipping and handling), or not? If so, I will relist it and we'll procede from there. If not, I will refund your payment via PayPal. Thanks." Well. That's it. I sent him a final message telling him to end this. I guess I'll get my refund and walk. His name was RetroJordan. |

Make sure the seller refunds your paypal money first ,then leave them appropriate feedback ,& after that you can cancel ebay transaction , make sure you do it in that order.
