Last year, a court had ruled that MGA could no longer sell Bratz and that ownership would go to Mattel. Accordign to Here, an appeals court has overturned that decision. For now, MGA can keep the property. But a new trial may be needed to settle the case again.
A federal appeals court said Mattel Inc was wrongly granted ownership of the popular Bratz dolls, a decision that could force the Barbie doll maker to retry the case for control of the $1 billion franchise. The 9th U.S. Circuit Court of Appeals in San Francisco said on Thursday that former U.S. District Judge Stephen Larson erred in ordering MGA Entertainment Inc to transfer the Bratz portfolio, including the "Bratz" and "Jade" names, to Mattel. Writing for a unanimous three-judge panel, Chief Judge Alex Kozinski also threw out Larson's injunction barring MGA from selling the pouty-lipped, multi-ethnic Bratz dolls, which were launched in 2001. He said the entire case, which included a $100 million jury verdict in 2008 for Mattel, may require a new trial. The full, original article may be seen Here.

I wish neither one of them could sell Bratz dolls.

$1 BILLION? There must be something very wrong with the world today if that franchise can be that successful. We've come a long way since Princess of Power.

Because we're action figure guys, we generally stay out of the "pink aisle"
But this business is cutthroat, and the entire reason Mattel initially sued MGA was because Bratz had actually gotten to the point of erroding Mattel's bread, Barbie (their butter being Hot Wheels :p )

I read up on the story and Mattel used every underhanded trick in the book to keep MGA down. Anyone for genuine fair competition in the marketplace should be glad Mattel's victory was overturned (even if the toys themselves are abhorrent). |

I think MGA should just stick with the Moxie dolls, as they're something parents AREN'T against buying for their children. (I would much rather give my 6-year old niece a tweenage girl that likes to be creative than some skanky whore who doesn't wear a bra.) But I do think Barbie needs some more help...aside from Monster High (Which isn't connected with Barbie), the only dolls I've been drooling over are the "Twilight" Pink Label dolls.

The recent Wizard of Oz barbies are really nice too.

But this business is cutthroat, and the entire reason Mattel initially sued MGA was because Bratz had actually gotten to the point of erroding Mattel's bread, Barbie (their butter being Hot Wheels :p ) That's part of it. Likely the biggest part, but Mattel also claims that this Bratz style of doll was designed and pitched as the next evolution of Barbie in house at Mattel, they also claim that the designer left their team and then pitched the same idea at MGA...now Mattel is saying since he was part of their team when the idea originated that they essentially own that design still and that it was stolen from them. Personally I think Mattel is grasping at straws...yeah they may have some legal precident that entitles them to some pay out from MGA for this but it seems pretty flimsy. To me its like saying any doll made by any one who leaves the design team is Mattels property. But I guess all of this depends on what Mattel has on file as their design property. Who knows maybe they have the exact design on file and actually do have a right to claim theft. But it seems odd that they didn't do so early in the Bratz line run. Instead they waited and saw if it was a threat to sales then pounced. And lets be honest here...I think the Bratz fad came and went, so I can't really see any real reason other than wanting to crush all doll oposition and set an example that Barbie is not to be messed with. |

Oh yeah, I like the loli-style ones that are going to come out. But I don't know why they thought 'Sexy Dorothy' is a good idea...looks more like Katie Holmes in a Leg Avenue costume-
