Maurader is careful to say that it's products are not based on and/or for any particular product - merely, 1/18 th scale figures. Also, most of Maurder stuff is replica's of actual existing/historic firearms [the danger there is that the gun manufacturers come after you rather than Hasbro].
To be really safe, you have to come up with all new designs that are uniquely yours. However, that isn't even a guarantee. I never saw any similarities between Bratz and Barbie, but Mattel got a Court Order saying that Bratz infringed upon their Barbie trademarks. The real way to avoid getting sued is not to be a threat, financial wise, to the big guys. That is why Bratz is gone, but Marauders is alive, imo The question is strictly in regards to someone manufacturing "exact" replica accessories for vintage figures such as GI Joe, Star wars, MOTU, TMNT, MEGO, 70's and 80's toys that are over 25 years old that exist but Figures and Vehicles are far more abundant than the accessories that originally cam e with them. If Mattel or Hasbro want's to make accessory packs great, then collectors wouldn't have too worry about it. Until then..they leave the door open to market.

I think this^^^^^is part of it. Even if it is a Luke skywalker Lightsaber, you can't call it that...you have to get creative like "Space Wars Yellow Sword"

You can't reproduce anything Hasbro owns, legally. Period.
You might get away with it for a while, and if it's small time, you'd likely merely get a C&D, but it's possible you could get sued, too. But yeah... the law says no actual reproductions without Hasbro's permission.
