As someone else pointed out, he applied for a patent on the name and logo. It hasn't been granted yet.

He applied for a trademark. You can't patent names or logos.

Another red flag: this Airwolf guy posted his Kickstarter link to a comment on one of my Instagram posts that was G.I. Joe related; nothing to do with him or his product at all.

If I was rude to you, it's because I don't suffer Trolls or Internet Lawyers....and you've been thus far acting as both. 1st: If you think I did any of this without consulting a Copyright\Trademark attorney, you are sorely mistaken. 2nd: There are Copyrights, Trademarks and Patents to protect what is colloquially known as "Intellectual Property". On Copyrights: Universal owns the Copyrights to all Airwolf Scripts, media and music score. I pay a royalty to use them. That's right...I pay my dues. Imagine that? On Trademarks: A trademark covers protections for Brand Logo's and Names for specific products listed as "Categories" that a business may sell with that Name and Logo. Universal abandoned the Trademarks for ALL Airwolf Toys back in 2007. They did not retain the rights and allowed them to expire. I have filed and have passed initial checks for our Airwolf Name and Logo under the following categories: Clothing, Action Figure Toys, Mechanical Action Toys and Scale Model Kits. The entire process takes 6 months to a year but I am afforded Brand Protection as soon as I filed the necessary paperwork. Technically as soon as I started using the Brand Logo ...but that's a "poor mans Trademark" at best. On Patents: Patents are for physical inventions and do not apply to this as neither Universal or I have anything Patented. I may apply for a Patent for my toy if I so wish...but it doesn't stop someone from China ultimately stealing it. 3rd: What's your agenda? You've followed me around multiple forums throwing shade at something that you know less than ZERO of what you speak. Edit- Also he doesn't really talk about his manufacturing process, or what kind of background he has for larger scale manufacturing. I know he 3d prints stuff, but that doesn't mean a lot when it comes to fulfilling something of this scale. How is that a red flag when I AM working with vortiouscustomaccessories?? He is designing and manufacturing the bodies for the project. Don't take my word for it, contact him on Facebook if you don't believe me. Tell him I said Hi to Bella and Big Ace! |

(Also, I'm totally gonna go check out your patents! ) As for my agenda, I was just looking to warn people about something that looked questionable to me. I saw how defensive you got when other people asked (and how you dodged the question) and that looked like every other guy I've seen using an IP that they had no rights to. Why not put the information you gave in this post into the Kickstarter up-front? That would've put a lot of minds at ease and actually demonstrated your experience in this area. I'd have asked you myself but - as I've noted a few times here - we haven't interacted on Facebook, and based on your interactions with other people I didn't think you'd take my questions well.
