It doesn't matter how many lawyers they talk to before it is challenged in court. Even if challenged in court there is always the risk of a person filing suit again. An outcome is not guaranteed and lawyer's fees will still accrue even if a case is frivolous. Only if one side wins and the Judge orders payment of the others sides fees... That is if you can still afford to make it to court with all the games and counter filings...still it is the lawyers that make all the money in the end. Best to avoid the risk, either get proper approval or insert errors/changed so there isn't any confusion.

I'm thinking it's the scale of it that helps them, even Hasbro is using licensed guns in the Classified Retro line now, I don't think gun manufacturers look into Joe weapons. However, they're very interested in infringements with BB guns or guns used in video games because they often have licensing contracts for those depictions or products.

Well, let's just hope the manufacturers continue to overlook or ignore the action figure weapons so we can get semi-accurate firearm representations in toy form for the time being.

Because they have not defended their properties in the past doesn't mean they won't in the future. Yes, having an established history of allowing infringement is a good defense if it has gone on for years. Hasbro does have deep pockets and would be the ideal target but the PR optics of Colt vs Hasbro. Yeash! Then again it would be a blessing for the anti-toy gun people in the toy industry. Until the case is settled they could remove all toy guns from figures, DC trying that already, and then publicly claim 'don't blame us blame this pending lawsuit'. They achieve a goal and get to deflect blame with a very plausible reason.

All the jokes about breathing and grip. And 90% accurate, leaves 10% variance. Not a replica or duplicate. Believe we are in agreement... Or at least I agree with you and DarthBrett.

What about the new Shotguns that Covergirl and Falcon come with? They look vaguly real-ish.
