Yeah, very well could be a saiga instead, it just feels a little undersized and the main reason I gravitate towards it being a rifle is the interchangeability of the magazine with the normal Alley-Viper gun.
A mag fed shotgun certainly would be a good piece of kit for them though!

I hope this is never challenged since it is more of a case of, "It's a toy accessory" and not enough money to be made in the lawsuit. These manufacturers don't have deep pockets. A digital render or a practical sub-scale model for training can't be confused for the actual item but still needed trademark approval from the original designer/manufacturer/Rights Holder. Mostly because, we had deep pockets.

Spirit's 25A rifle looks like a Ruger bolt action that has had a dart magazine added to it. |

The argument of scale and walking in to a bank with one is not a strong defense against infringement.

I'm reminded of Call of Duty's lawsuit with Humvee, the games used to license out partnerships with gun manufacturers like Remington but with the last two Modern Warfare games, they have modified their weapons to resemble the guns they're based on much less than other developer's games. Even though they won the lawsuit with Humvee, they're nervous to illustrate the guns exactly; the majority of games out there model the gun correctly but just swap out one letter or two to have the names be different.

Further, guns over 50 have expired patents, this is why multiple manufacturers produce the same firearms or their depiction in games is 1:1 to realism often with their proper names. The Soviets didn't patent their weapons because they intended for every communist country to use their designs for uniformity so the Kalashnikov is fine to use however you like, where something like the FN SCAR could be infringing if used. |
