I think you are making a big deal out of nothing and the both of you are mincing words. If I sell an item that is MOC and sealed and it breaks out of the package when the buyer opens it, how am I responsible.
On the flip side, are you seriously telling us that when you sell a MISB item that you inspect eveything inside and out to make sure there is no damage? Highly doubtful and it would be rather insulting if you expect us to believe that you would or do. I think you are being extremely unreasonable here. If anything, I was not aware that Cliffjumper sold for so much and I would never pay that price to begin with. This sounds more like buyer's remorse to me. If it DOES sell for so much, you can simply resell it yourself. Is the seller being a jerk? No, I think he is responding appropriately given the circumstances and having to deal with such a difficult buyer. Remember-don't shoot the messenger. I am just giving some honest feedback here. Lody, I agree with most of your first post, but Ive been on ebay since 1998 and done well over 500 transactions. Ive only left negative feedback twice (both times were scams and I was not sent the item) and neutral maybe 2 times. Never had either left for me. If I bought an item that was not as described, i.e. broken, and contacted the seller about it and they said they would have charged MORE for it as a variation, and not only that but they would NOT refund my money, youre damn right theyd get negative feedback and a case filed against them. I dont think thats too much to ask. But again, the photo sucks and I wouldnt have purchased it to begin with. Also, I always try to get insurance on my items I buy and ALWAYS put it on as a seller. There are numerous ways to avoid/prepare for these kinds of problems.

In this case, if I was buying this figure to open, then the picture is ok. However, if I was buying this one to keep MOC and saw a picture like that, it's an easy pass.
Either way I would not pursue this with the seller as this is not something that is normally disclosed in the auction. Again-his response is appropriate given the circumstances in that he is clearly aggravated with how the transaction is turning out. Didn't say it was right, just on par. Lourd knows I am dealing with my own eBay issues of right now myself. |

One thing to know is on ebay when you look at the condition that is a pre-worded selection that ebay uses.
Item specifics Condition: New: A brand-new, unused, unopened, undamaged item (including handmade items). See the seller's listing for full details. That is ebays wording not the sellers ^ |

If the seller did not see it I don't think it's his fault IMO. I personally would not have noticed if I had sold that.

guys, it is very obvious where the damage is. its right on the roof of the car staring you in the face.
i would have a hard time reselling it because i wouldn't list it without mentioning the damage.

the damage is staring you in the face, like i said. and yes i do look at any items i sell or trade and advise their condition. if it is carded or boxed obviously we can only look at what you can see from the outside...
