what exactly is going on here? I've seen some of this art from tankers etc.

They do this stuff with anything. A lot of these t-shirt/sticker guys on taobao, just take whatever they can find off the internet without a watermark on it, and put it up for sale. It costs them nothing to do this since they make them as they're ordered so the more art they have to choose from the better.

wow. that's... I mean I'd be flattered I guess. but man. that's... just odd. I mean bootlegging stickers and posters of official art is expected but man... of fan art... that's crazy.

This is a common practice, not only on TaoBao but also on ebay, ioffer etc. Masters Of The Universe, Transformers etc. fan artists are constantly ripped off (from deviantart & fan sites) when their work is not watermarked & high res online, high enough that a bootlegger can make a decent print. You can do something about it on ebay (report it as the artist or ask for it to be taken down) but Taobao would follow Chinese law where trademark rules are almost non-existent. Keep in mind that whatever fanart you do is not yours, if it's not your character, even if you make up a character & put it in the GI Joe universe, it's Hasbro's because it's based on their brand. My Helix avatar is my art, but It's Hasbro's character so technically, I could not manufacture anything with my Helix art on it legally without Hasbro's permission or share of the profit.

Yeah technically like 99% of the stuff we use online including logos, screen caps artwork hell even the stuff we use in sigs could be considered infringment.
But yeah I'd have to agree I think the line here is use of said artwork being sold. Its one of the reasons I've not sold any of the custom cards I've done. While I've done a lot of work on giving repaints new names and persona, the artwork is all Hasbro's. |

well.. there only one thing to do here. and is to place watermarks on our art. even if its not ours we (not i) gave some good time and sweat to make it what it is. and honestly i don't find ugly or tasteless a fan made portrait of a character with a big centered watermark.
and about our sigs and pics.. well... unlike tao we are not making any profit from them. and besides is always good to see stuff been shared... as long is not profitable. btw.. my sig is from Cromartie High School.. great and weird japanese Anime. you should all see it... See? that was actually kinda promotional... lolz

I think there is a loophole here though. If you only produce a certain amount hasbro cant do anything to you. i believe the magic number is 50. over 50 you can get in trouble. I may be wrong but i swear i read that somewear. this is how some of the smaller conventions can make exclusives out of joe parts without giving hasbro a cut.
