I realise that this is a bit of a rant and as most people here don't really know me most people wont care, but after making the mistake of watching Punisher while being in the thick of this; I'm ticked and feel like ranting.
To give people the backstory, at the start of October, I approached this guy and his mates about smoking in the carriage I was on because I've got a really bad dust allergy. Words were exchanged and they got violent and grabbed me by the face with their thumb over my mouth, after trying to intimidate me into getting off at another station which was poorly lit and deserted. I resisted until I bit hard into their thumb to make them stop, which they ripped away so hard that they snapped the tooth sockets of 3 of my lower incisors from my jaw and fractured it. They then followed me off the train when I did get off at my stop, and the guy caught up to me, overpowered me (at the time I thought he was on Ice- turns out it was just alcohol with him being the psychotically violent drunk type) threw me to the ground and slammed into my left eye socket multiple times with his fist and delivered 2 nasty kicks to the head. The left side of my face looked like it belonged to the Elephant man and on the right side of my forehead was a welt in the shape of his shoe logo. I wound up losing 2 of my teeth completely (the dental work alone is going to cost around $14k to repair the damage and take about 2 years to do) and having my jaw wired for 6 weeks, getting 2 fractures to the left eye socket and I still have numbness under the left eye and in the left nostril. Doctors at the time were amazed that with how bad the injuries were that I wasn't dead or a vegetable. Psychologically I'm going through hell- alternating between panic attacks of varying degrees and emotional flashbacks where you don't experience the memories or thoughts you had during the attack, but just the raw and blind emotion that you manage to disconnect from during the actual attacks. The flashbacks have lasted upto 60 hours of late. If the it would actually be over and done with, I could actually get some traction and start to move on, but the legal process keeps dragging on and so I'm stuck in limbo spinning my wheels so to speak. The guy plead guilty to both attacks on the day of the hearing in late Feb and was meant to be sentenced in late April following a psychological assessment and I was assured that it would be over and done with at that point. Half my luck- not only did they give me the wrong day for the sentencing (it was meant to take place the day before I was told it would take place), but it turns out that when he attacked me, he breached several bonds he'd been placed on and he needs to be sentenced for all of those bonds being broken before he can be sentenced for nearly beating me to death. I also found out he was on weekend detention. So the case has been adjourned until the beginning of June because the district courts are apparently backed up. That is of course presuming that it doesn't get adjourned yet again. On top of that, they can cross-examine me over my victims impact statement which could prove to be a real slice of fun, there's the potential for the judge to just hand out a wristslap which would be nothing short of an agonizing kick in the nuts. I mean I get why the system needs to be the way it is to protect people when the law gets it royally wrong, but it's like no thought gets given to the victims in terms of trying to make justice swift where possible and not make the victim feel like they're the ones who have to prove their not full of it. Gotta love the system hey? |

if you think the legal system there sucks you should experience it here in the states.i feel for you man.hopefully things work out for you soon.

That sad thing is we got people in jail for stupid petty stuff like possession and violent offenders on the streets doing what this is guy is doing.

Aw man, that sucks. Which part of Oz are you in? NSW I'm presuming. There's a bunch of Victims advocacy groups that might be able to help. There might be some cash to be had from the Victims of Crime fund to help with the dental work too..maybe. Good luck mate.

That sucks, it sounds like it was an unprovokted attack. I hope this guy is in prison awaiting his sentence.
Honestly I hate to say it, (I'm no fan of the legal system in the U.S.) but in a case like this the guy would be in jail. He also would not end up with a wrist slap unless he was very wealthy. Also you would be able to sue him for damages and in the U.S. there are programs that would help with your medical bills and believe me our healthcare is way screwed up here. I also hate to say it but in the U.S. we have the right to have guns for personel protection and in some places in the U.S. a guy like this would be afraid to commit a crime like this in case you had a gun. Also in some states with all the warrants he has he would be going to prison for a very long time. I am really sorry to hear what happened to you. Unfortunately the only help I can offer you is to say there are very effective medicines to help with panic attacks. I know there awfull when they are long because I suffer from them too. I truly hope this guy spends the rest of his life behind bars, and hope that you heal well and soon. If there's anything else I can do to help feel free to ask. |

Dude, I'm sorry bro. Are you going to be able to sue his ass for damages? Here in my state they have what is called a victim's reparations program where the state collects monies from criminal douchebag f*ckwads like that dipsh*t and pay for medical treatment and other expenses related to the attacks. Look and see if they have anything like that in AU.
Keep your chin up man, that is some really scary stuff. Are you seeing any type of therapist? Early treatment after such an incident can help you heal mentally and emotionally from such a barbaric and disgusting act. Good luck man, that is some tough stuff. I work with the courts very often in my line of work and they can be a real kick in the balls. I would recommend speaking to the prosecutor in the case and having him educate you on what you can do on the stand. When you're testifying, just remember to stay calm and do the best you can. The best piece of advice I can offer is to tell you that (at least here in the states) that you can take as much time as you need to collect your thoughts before you answer. you can also ask the defense attorney to repeat the question or rephrase the question if you do not understand what he is asking. Take as much time as you need and work the answer out in your head before you speak. Again, talk to the prosecutor and get some advice on how to testify. If you're prepared, you'll do great. hang in there brother! This is a bump in the road, better days are ahead!

i remember a few years ago i was thrown in jail for a driving with a suspended license ticket i forgot to pay and when i went before the judge he set my bail at $500.00 while some dude who was in on his 5th possision charge had a $50.00 p.r. bond,wtf.i think they legal system needs a serious overhaul.

Now that I'm older I don't say anything to anyone unless they are directly threatening my wife and kids or my life. As you found out it's not worth it. I've found most people who are acting stupid are stupid or are jerks and will not stop no matter how polite you are about it. You should be able to do what you did, but in this world you can't. I hope it all works out for you and he gets what he deserves.
