O.k. gang here's the deal: I sold the Rock Band game for Nintendo Wii a few weeks ago on ebay. I shipped it Parcel Post with insurance and delivery took a little longer than expected (shipped on 4th-delivered on 12th). I specified that the item is "sold as-is no refunds" in the auction description.
I receive an e-mail from the winning bidder today stating that everything works except for the drums. Apparently they shut off after a few minutes of play. The drums were working fine when I had them. I'm wondering since I insured the items, what re-course do I or the buyer have? Is this something that will be covered by insurance or is it one of those things that's impossible to prove? Even though I stated "as is no refunds" can the buyer still get their money back (i.e. will Paypal reach into my account and take the money out?) If I offer a refund will I have to also refund the shipping amts? If I do give a refund I'll be out anywhere from $100-$140 depending on if I'm required to refund the shipping amts. As I'm unemployed that's something that I can't really afford right now, so as you can imagine I'm feeling a bit tense over this. Any help or advice would be greatly appreciated. |

Offer the guy a small refund, say 20 bucks for the trouble. Then have him call the manufacturer to get the drums replaced. If USPS doesn't cover it, which I'm sure they'll give you grief.

If the drums weren't damaged in transit, then the USPS will not cover any claim. Items being faulty are not the USPS' responsibility. Now the burden will fall on you to prove that the drums worked prior to shipment...but, in the same respect, since you did list "all sales final", you at least have a fighting chance.

If the buyer files a claim with paypal then you will probably lose all of the money, go with the offer of a small refund someone else suggested and hope that is the end of it.
USPS will do nothing for you. |

Ebay does let you specify a "no returns" policy, but the buyer might claim the item arrived "other than advertised" and try to use the paypal protection racket. Ebay seems very concerned with keeping buyers happy, but cares little about sellers.

Thanks for all the responses. I'm checking to see if there might be some technical issue that is common with the drums, but so far i haven't found anything.
I sent an e-mail asking the buyer to first replace the batterires and then re-link everything as this might have something to do with it. I looked up some info on insurance claims through the USPS and C.I.A.D is right, unless the item was packed really well and still busted all to crap, they will not pay. I figured that offering a partial refund is probably the quickest and cheapest way out of this, although I don't know what a fair amount to offer would be. |

Also, if the buyer files a "item not as described" claim are they first required to send the item back before Paypal reaches into my account and gives them their money back or will they get their money back and get to keep the item?

The person on the other end may be less than honest, you know? Maybe this person just wants a discount. I would contact eBay/PayPal, explain the situation and see where it goes. If the Buyer files a claim, at least you have a leg to stand on as you've been proactive rather than reactive. |
