In a normal ticket, an officer has to show up to speak his side in court but in this case there is no one to go up against so in a real court case if no one shows up in defense of the ticket it should be thrown out.

In America, you cannot be held accountable to a court of law unless you are legally served a summons to appear. This is usually a document that requires your signature. When a police officer gives you a ticket, you are required to sign at the bottom of the statement because you are basically acknowledging your due process. You can either pay the fine, or appear in court. Either way, you are communicating to the officer that you will do one of those two things, and that is why the officer lets you go on your way. That said, there is no way of proving you were served a legal summons to appear since most SCAMERA companies and the kangaroos who implement them issue a summons using a 42 cent stamp. This process is not trackable, and the person being served the "violation" has no guaranteed way of receiving the "violation." Because the kangaroos cannot prove that you received the notice to appear, request for cash or violation proof itself, they have no way of proving that you received it. Therefore, they cannot legally hold you accountable for that. 2.) Most kangaroo courts that utilize the scamera system are depending on you to either pay the fine or appear in their very own kangaroo court. If you don't do either, then the penalties will vary from one state to the next. Since many states are acknowledging my first point and declaring the things a criminal means of cashing in on their citizens, they are taking the cameras down and banning their further use. 3.) Red light cameras cause more rear-end accidents than intersections without them. I was nearly smashed into at a red-light camera intersection once from behind, and it scared the ever living shite out of me. I jammed my brakes because the light rapidly changed from green to yellow, and I was afraid to risk it and get zapped for a ticket. So I jammed my brakes, and heard the distinct screeching sound of tires from the vehicle behind me as I feared he would slam into me from behind. Thank God he did not, but it sure as hell was close. 4.) Here is the best question you have to consider when facing the kangaroos: Can the kangaroos prove that it was YOU driving the car? If there is no image of your face in clear view at the "scene of the crime," then how can they legally pursue legal action against you if they cannot prove you are guilty beyond all reasonable doubt? 5.) Many kangaroos who implement the cameras are guilty as hell of criminal behavior and corruption. Big mistake, I was told that the picture was the accuser and that it clearly showed my car. The judge then asked me if I was driving my car at the time. I said yes and he said "guilty as charged". They then charged me for court fees as well as the stupid ticket.
Since he couldn't do that, you should have replied, "PROVE IT WAS ME." I give you points for honesty, but it's a shame the kangaroos got your money. Sorry to hear of this news, hot stuff. :( |

If you've got a case fight it. That's a huge hit to your insurance bill. What are the local rules there?
