It's the principle Kneroh, and it should be legal to shoot anyone who would destroy your property that you work your ass off for. Let's say I have that new Acura and some crack head wants the stereo, it should be that as the crack head you risk your life/freedom(what little you have to begin with, if you're a crack head you have less freedom than the general population), for the car stereo, with the fact in mind if the owner catches you and is armed, be prepared to face the consequences of your actions. Plus it would send a market signal to the rest of the scum of society that yes, if you mess with people's property and you are caught in the act, it's between you and them.

Kaboomskie - probably not, unless a reasonable man would believe that a person was in immediate risk of death or serious bodily harm. Someone breaking into your car, and you shoot them, would probably be excessive force, and you'd go to jail.

I get what you're saying having someone steal your shit is the worst. But just for calm, rational, honestly no trolling at all intended arguments sake I also have a new Acura, same year and color as yours. Mistakenly I walk up to your car, pull the handle, alarm goes off... and now I'm dead. We live in a country where one is innocent until proven guilty. An armed populace with basically little to no restrictions on how punishment can be carried out just seems like a very dangerous world to me.

I guess it depends what state you live in, but in California, that would be a no. To shoot someone here they have to be in your house and have some kind of lethal weapon in there hands and you would have to feel your life or the life of others in your home where in danger. Then you can shoot the bastard.

Ahhh... no. If you were in the car at the time and he was smashing the windows out, then yes you can cap him because you likely would feel like your live was being threatened. But you can't shoot someone for breaking in to your car and posing no threat to your life or that of your loved ones.

Fair enough. But if it were parked in my driveway and on my property, and you go up to the door handle, then your intentions are different than mistaking my car for yours. But to set the record straight we live in a country where you are guilty until proven innocent and the TSA will attest to that.

It's the principle Kneroh, and it should be legal to shoot anyone who would destroy your property that you work your ass off for... what signal does this send to thieves? That they can now use the court system to sue people they were going to rob if they get shot.
So should it be legal to shoot would be thieves and violators of property? Yes absolutely becasue when you violate people's property rights, this is what happens. Do I think that theives should be allowed to break into somewhere and get injured and then sue the owner for damages? No. The fact that people can do that in the US is crazy but it is also a consequence of letting lawyers into politics. It is up to the citizens of a democracy to make sure they are electing the right people for what they wish to have happen.

I see your point but the store owner was in the wrong because it is the law of the land that you can't shoot thieves as a business owner. In my state you can shoot theives in your house especially if you feel your life or the lives of anyone in the home is in danger. It is up to the citizens of the city or state to change unfavorable laws.

No. The fact that people can do that in the US is crazy but it is also a consequence of letting lawyers into politics. It is up to the citizens of a democracy to make sure they are electing the right people for what they wish to have happen. all of them involved a thief getting caught in the victims house/buildings and having to stay there for a period of time before being found..... one was in Cali, broke into a home that he knew the people were on vacation, somehow got stuck in the garage and had to live off of freezerpops for 5 days......he sued and won.... thief got stuck in a chimmney, family was out for 3 days, he was there for the next two days, Fire dept had to dismantle the chimmney to get him back out......he claim was that if they wouldve had a properly attached chimmeny topper he wouldnt have tried to get in........How did he know that you may wonder...........he was the guy that installed the topper! he sued and won....... there were hundreds of these suits listed........if I can find the site I will link it again, but its been few yearsI(and several computers) since I last thought of that |

But the US is not a democracy, it's still a constitutional Republic.
