It's cases like this that the buyer is admitting it's their fault that Ebay should protect its sellers. I mean, if it weren't for the sellers there would be no Ebay. I think Ebay needs to take another hit in the shorts to see that it's the sellers that drive their business and it's the sellers that pay them. Instead you have the company take an approach of : "Let's punish the very people that drive our community and business". I think if more sellers went to Amazon Ebay would loosen its already too tightened belt a couple notches.

It sucks but I agree with what a few others are aying---it was a low dollar item so offer a partial refund---like 10% and see if they bite

I sent her a message but haven't heard back. I'm not going to offer her any money back unless she threatens me with bad feedback. Hopefully she just doesn't give any feedback at all and I don't hear from her again.
This is the message I sent her: Dear sarahmeyer2001, hmmmm... i'm not really sure how to handle this. After receiving your message, I did some research, and apparently this figure is prone to having extra tight joints and breaking. This is a five year old figure that has been displayed in my house for that amount of time, I can't imagine anything that I did would have caused it to break easily. I'm guessing Marvel didn't use very good plastics when they manufactured it. These Marvel Legends figures are typically for Display purposes only, and shouldn't be handled aggressively. My Marvel Legends Abomination is dead. I would suggest putting some lock tight in the arm sockets, reattaching the arms, and displaying him. - jlarrick31

This is why ebay is a borderline last resort for me and generally only if I'm looking for parts. When it comes to buying 95% of the time I shop here and the other 5% is amazon.
Your best bet might be to take a dump in a box and send it to her. Tell her it's the brown Man-Thing variant. |

I think the main issue is that eBay doesn't distinguish from people running a business and just a dude selling some stuff like a garage sale. When you buy something at a garage sale you take on a certain risk knowing the item is used. Buyer beware and all that goes with it. This isn't Walmart Things are sold as is and the buyer doesn't have a reasonable expectation for a refund if they are not completely satisfied or if they break it. Even if the item was unknowingly broken but the damage could not be seen until it actually broke. That's just tough. I think the eBay policies should be different for people that are power sellers or whatever you call them and people that sell a few items once in a while. |
