Does it make me a bad person to hate teenagers(or atleast the dumb ones?). in a moment he lost it and he grabbed the bat he was beaten with to lash out against the person who was beating him with it. i don't condone it but i can understand why he did it. even though my brother ran towards them when they came back the 3rd time they still would have jumped him had he stayed put in front of the house. that's why they had the bat. what annoyed me was the yelling and lecturing they tried to give my brother. and one cop said he could have shot and killed him because he had the bat in his hand. he might be right but how is stating that helping the situation. and did they still have to knee my nephew in the back after we told them he just was running towards his father out of concern. the kid had already been taken away, and he wasn't trying to attack his father. my nephew was not resisting in any type of way too. i guess they couldn't admit that it was a misunderstanding and they arrested him anyway. he was later released without any charges filed on him. my nephew must have done something really terrible to that kid to spark such anger. or he's just nuts. |

Well for those who are saying sue the cops it doesn't work that way. The cops show up, secure the scene, then figure out what happened. The fact is your brother had a weapon when the cops showed up. That almost always results in the person with the weapon being in cuffs. It's protocol to hand cuff anyone who could be a threat, regardless of who started what. They show up and people are scattering and someone has a bat. The cops don't know who is who when they show up. The cops did show up earlier but there's really nothing they can do unless someone has been harmed. That's just how the law works. However, had the chops arrived when the kids were out front with the bat they would have been arrested on ther spot. It's best just to stay inside and wait for the cops. It's tough but that's the best thing to do. As for filing a lawsuit against the kids parents, you would have to have proof of what kid did exactly what and I'm sure they will all have different stories. If you can prove that they did harm and prove who it was then you have a case but it's very difficult. My neighbor is a cop and we were discussing a similar situation not too long ago. But the good thing about Florida is we have the ” Castle Law” where basically if you feel threatened in your home or yard you have the right to use force against anyone who enters your property.

i agree totally he should have. i could have forced him back in the house. but i lost my cool too. it's hard hearing some wise ass stating he's going f you up and f your mother and sister-in-law and not say anything back. but the kid is only like 16 or 17 and i should have known better. i am worried about my 10 year nephew, that kid could really hurt him. if he's willing to attack a father why not a brother.

i have some gripes with some of the things the cops said and how they handled things but not with the charges. my major concern is this kid and what he might do and the safety of my nephews. if they jump me i'm sure i'll survive but i can't say the same for my 10 year old nephew. |

well first off........im sorry to hear of your plight.secondly.. over here in england,we are an island race....and its in our nature to be up front and aggressive[im not saying were all feral and psycopathic]but as the old saying goes"an englishmans home is his castle"and believe me if that situation arises here[and it does!]people normally fight tooth and nail to defend their family and home.my suggestion is this[you will get nowhere with the police]so....speak to this little shits parents/guardians and try and resolve it that way....if theres still no joy,then give his parents/guardians an ultimatum:if their kid wont stop his campaign against you than calmly tell the parents that each time he performs.. you are gonna beat sevens shades of shit outta the kids father[of coarse,when there are no witnesses around]it might take a bit of planning...but hey ,when your backs against the wall,you gotta improvise....chances are father and son are both the same.this may seem rash...but sometimes violence is the only thing that will bring them to their senses.just my opinion. good luck mate.

^This. I would have popped out my iPhone or Flip as soon as all this shit started. That damn kid would have been on the Web (and the news) for inciting a mob, his parents would have given him such a beat down he'd never walk again.

Who gives a shit about the kids age? They showed up 14 deep with a bat. Even if everybody stayed inside, as worked up as these kids were they probably would have destroyed property. They were confronted ON the property and your brother was attacked. Now there are multiple witnesses that say that the cops improperly contained the situation and caused further injury to your brother? It is hard as hell to fight the law but I would definitely take this to court.

We use the door seal policy.....once over the door seal it is self defense or defending your property. You should kill and not maim though, you can pay for those crippled kids for life.
