Illeagal is the wrong word. My appologies. It still constitutes unfair buisness practices. It's more "against the rules" than illeagal. People who do this ( Hold hard to find items for specific customers) is generly frowned upon. The legality of the instance comes into question if the guy is paying kickbacks to the store clerk to do this for him( Atleast in Georgia, Or so my former District Manager tells me) . the stores DO frown upon this, it's just a question of wheither or not the store management cares enough to fight it.

And in response to the CompulsiveCollector, most states require that you have a license to be a reseller, so scalping is illegal. If you want to sell something you have to have the license, and then in turn get your stuff from Hasbro in bulk. But Hasbro won't sell to you in bulk without the license. So actually, anyone who is hoarding Joes for their own personal collection (e.g. army building) is not doing anything wrong (even though I personally think army building is fruity), but anyone who is buying them to resell them are, even if it's just a few figures, doing so illegally. I wanted to point this out because lots of people around here like to stick up for people who buy out the whole stock, but most of the time they are doing it to resell and therefore doing so illegally. If they were decent citizens they would go get the proper license, like every other business, and then buy wholesale in bulk, and leave the f****** figures at Target, TRU, and WalMart alone for people who just want to have them. Again, if your just buying them for yourself, then your are within your rights to buy the whole f****** store. But I don't think anyone is actually buying 3 snake eyes figures just for themselves. how would one define a "reseller" legally? would anyone who sells something that they didn't build themselves be considered a reseller, and therefore need a license? if that were the case, eBay would collapse completely. i wouldn't be able to sell extra stuff i have, or get rid of old junk (to me) that i don't want. i don't like scalping, because i think it generally drives up prices to extreme levels for periods of time, but i'm not aware of anything that is illegal about it. it is frustrating to go into a Target that you know got 3 cases of wave 7 in, and go in there and all that is onthe pegs are a Buzzer and some comic packs. but, that's just the way things work. nobody is any more entitled to buy figures than anyone else. I'm just glad that the action figure market in Britain isn't big enough for things like this to happen here otherwise I'd be on my third ulcer by now!

I do not know the laws in every state but I do know that you do not need a seller's license if you are in individual and only sell on ebay. If you are an actual business and do business on ebay you better have a license. Some states are trying to pass laws requiring that all sellers on ebay or the internet in general have licenses but I dont think any have passed yet. Heck some states are trying to pass laws to require a license to have a garage sale. States require you to have a license so you can charge tax and thus pay the state tax.

By the way CompulsiveCollector, I just noticed your site with your big spiel about scalpers and what not. So do you have your license? I'm pretty sure you need to have one in North Carolina. In fact, I'm pretty sure North Carolina also has separate laws pertaining to scalping.
