Lawyer here. I would never take this case. First, I believe its a waste of time. I think too many people on this website have their panties in a bunch over nothing. Don't sweat the small stuff. These Con sets aren't investment vehicles or some Salvador Dali print. They are toys. I find the "rable rable rable" and "torches and pitchforks" fuccking hilarious. Get over yourself. We are grown men (and some women) collecting toys. If the Club continually pisses you off, just stop buying.
Second, there is no money in this - okay, I have some pissed off people, but not everyone is going to want a refund and I doubt one could say they were "damaged," so it isn't worth the time of day to me and it definitely shouldn't be for you. Your legal fees incurred by a lawyer would eat into your refund. In addition, they did protect themselves with the fine print. They are apparently changing the certificate as well. There is also a gray area as to what "limited edition" means and the effects of second printings etc. I would be down for a conversation on the meaning of that with another lawyer. Third, do you want to help build the brand or bring it down? Because a lawsuit is a lose-lose. No one would win from that. Finally, for some perspective on where I stand, I bought a set for $585. 2 DAYS before I got that email. Oh well. Not a big deal, the world still spins and I am enjoying my 2012 set as we speak. I think it was awesome. And I would definitely buy a 2011 second run.
