I noticed it while watching DUKE reviews and while looking at my retro DUKE, (dope figure by the way,) with the exception of the color DUKE'S jump wings looks exactly like the Army's
In my old age my eyes are beginning to fail me, so I'll need y'all to point out the differences, but as in my opinion I see no difference between the Army's Parachuist Badge and DUKE'S.

If it's official government insignia I don't believe they have to get permission at all, any more than they do to use the flag itself.

Plus, it's not a Trademarked/registered logo.

The Army's Parachutist Badge, or Jump Wings, worn by Duke might only require a written permission from the Director of the Army Trademark Licensing Program in Arlington, Virgina.
Each Military Service has a Trademark Licensing Program Office that manages its graphic and word trademarks (including common law trademarks). They may not even have needed written permission due to making them gold. While jump wings might have gold stars on them to signify combat jumps, they are never gold themselves. Also it looks like the inner edges of the wings aren't EXACTLY the same.

That's interesting. That would make sense for a non-profit. If that's the case I'm surprised the Army gave Hasbro a "freebie." I guess DUKE was somebody's favorite JOE at the Army Trademark Licensing Program. LOL.

But is it enough to make it distinguish it from enough from the Jump Wings? For example, You're not going to mistaken the insignia on L.J.'s cap for the Jump Wings and then there's the guns. There's no one-for-one copy of any real firearm in the Classified Series there's always a major change in the design of a Classified firearm and it's real life equivalent. Where as with DUKE's Jump Wings casual observers will think that the badge are the Army's Jump Wings.

To me it's like not a big deal at all. I'd think the Army would just go "oh cool" rather than try to sue a toy company who is releasing a realistic military figure. Maybe I'm naive though.

Yes. This is why Gung Ho doesn't have the USMC Logo. For the S7 version, Brian Flynn said (paraphrasing a bit) "You have to pay to use that logo. And they didn't want our money." Although they did put the red cross on S7 Doc while the Classified version's is white so who really knows.
