Well, if the trademark is for specifically the symbol being tied to anything Arashikage i guess it make sense if we use the Xbox example. Which means everyone else can use it as long as it's not tied to something dealing with Arashikage.

The problem with it being tied to Arashikage is, the symbol is literally the letters/symbols for Arashi and Kage. Arashikage is just a word. It would be like me copyrighting ABC. Now, ABC, the network, can copyright their logo, because it is unique, but they can't copyright any use of the letters ABC in order. That would be ridiculous.

嵐 =Storm 影=Shadow That symbol is just a symbol used to identify the Arashikage clan. |

You're right Crazy Legs. It's been a while since I looked into this (I was actually looking for Japanese names for a completely GI Joe-unrelated story I was writing and came across the Storm Shadow thing randomly).

...wait...how do you trademark the 63rd hexagram of the I Ching?...I'm pretty sure it predates GI Joe by a minute...
This seems a little silly to me... Last edited by Fred Broca XIII; 02-24-2012 at 04:56 PM.. |

How can anybody seek to trademark a religious tradition or a philosophy? Isn't that unconstitutional if the US govt allows it?
Bad Hasbro, bad! Leave Taoism alone. May a monk emerge from a temple and kick your articulation-lacking butt for even attempting this. |

I really think this is kind of bullshit.
Sure Hasbro should be able to make this product with this I Ching symbol but there shouldn't be anyway to copyright it. This is free domain as it is such a basic design seen on so many I Ching fortune books in the metaphysical section at my local book store. Putting a trademark on this would only cause problems for everyone else and this is not like a Coke or Pepsi logo. It is a couple dashes and lines. Hardly significant. Marvel, Hama, and others have used this for decades without incident. Only now does this happen? May have to dispute this trademark application as I think this is wrong. Here is US Patent Office web site to dispute applications. I urge everyone to seriously consider it. This is much like PIPA and SOPA. USPTO TTABVUE. Trademark Trial and Appeal Board Inquiry System While I agree with you that it seems kind of stupid for Hasbro to apply for a trademark on the 63rd character of the i-Ching alphabet/hexagram, I don't think this is anywhere NEAR as important as the PIPA & SOPA internet censorship bills. That seems slightly hyperbolic to try to equate the two issues together like that. Please allow me to restate that I think this is a ridiculous ploy by Hasbro to cash in on something they just borrowed to relate to a comic book/cartoon/action figure character. If they had a legitimate claim to the symbol itself, why didn't they trademark it before? It's only because the new G.I. Joe movie is so Ninja-centric that they are only now trying to sow up the rights to as many things related to it as they can to keep as much money for themselves as possible. That aspect to me, is really disgusting. Maybe Hasbro shouldn't have plastered the ARASHIKAGE symbol all over it's toys/movie merchandise before thinking about how easy it is for people to make a t-shirt with something that Hasbro never had a legal claim to in the first place? Go ahead and put the ™ mark next to ARASHIKAGE. I don't really give a crap about that. The actual symbol you've been using however, is NOT YOURS, Hasbro. NO TRADEMARK FOR YOU! Some of you may remember back in the N64 days when Nintendo used the moon star as the symbol for puzzles and switches and such. They no longer do as it is an Islamic religious symbol. I can see them Trademarking Arashikage, but a hexagram. I wonder if anyone will challenge this. I doubt that Hasbro will be able to sue anyone for using it and win. |
