I was on heroscapers.com today, and saw this thread from the webmaster, "truth":

In case you're wondering why we're actively policing the use of the term, it's a legal requirement that we do this. The term Army Builder is a registered trademark belonging to Lone Wolf Development and as such we have exclusive rights to use that mark in connection with any game-related computer software. If we allow the improper use of our mark, we could ultimately lose the trademark, which would allow another company to legally release a competing product called "Army Builder". We are thus required to do this. If you are interested in understanding this issue better, there is an excellent article on wikipedia (see Genericized trademark - Wikipedia, the free encyclopedia). PLEASE NOTE! Anyone is absolutely welcome to write their own roster creation tools - we have no desire to suppress other people's creativity. Okay.
Sounds like it is trade marked in regard to the software. So if you're planning on naming a software you'd have to rethink. That should not stop us from using it as a general term for building an army out of small soldiers. |

Lots of things are copywritten. Like Three-Peat. We just can use it in terms of computer games and were fine.

Not to mention that if it becomes a "common-use" word like Xerox, they can lose the copyright. Adobe is going out of their minds trying to get people to stop referring to photo-edits as "shops" or "photoshopped", but there's very little they can actually do to stop it, short of throwing about a lot of pseudo-legal threatening letters that likely wouldn't hold up in court anyway.
Technically, the term "superhero" is a shared trademark of Marvel and DC, but I'd really love to see them try and defend it in court these days. |
