Would Cobra Commander get away with terrorism due to an insanity plea?

I voted yes. I do believe he has been shown to have some level of actual insanity on multiple occasions. However, I don't think the plea deal would work for him. Some men need to be removed permanently.

Cobra Commander, if tried for treason and terrorism, could NEVER get away with an insanity plea. Just suffering from a mental disorder is not sufficient to prove legal insanity. It is hard to determine legal insanity, and even harder to successfully defend it in court.

As the leader of COBRA, did Cobra Commander ever attempt to wear a hood or helmet with full-faced mirrored visor to disguise his identity? Why would he go to any lengths to hide his location or identity, if he was mentally incapable of knowing that he was doing wrong?

Zero percent chance of entering an insanity plea.

Contrary to what Hollywood portrays, insanity pleas are extremely difficult to win with in court and specifically aren't just about "being crazy" as "able to tell right from wrong/legal from illegal." He could of course attempt it, but for the reasons mentioned above coupled with a whole lot of other things, it is going to be unbelievably difficult to prove that he couldn't tell right from wrong.

He'd probably have a better chance claiming Mindbender was the real mastermind and used the Brainwave Scanner on him to control him.

No courtroom would believe an insane person would be able to organize such an huge military force. It didn't work for monsters, like Bundy and Dahmer, and it won't work for CC.

No. There's no chance he makes it anywhere near a courtroom. Best possible outcome is the way devils due ended, locked in a black site being tortured (i mean questioned) for the rest of his life.

I wonder how far down you would have to go to have someone actually stand trial? Maybe the twins?

Depending on which version of CC you're talking about, the comics version is an American citizen, so disappearing him into a black site for torture would be heavily scrutinized. I mean, civil right's groups already do that about foreign terrorists locked up in Guantanamo without trial... imagine how they'd react to an actual US citizen having their Constitutional rights violated?

Cobra-La CC, on the other hand...
