I doubt that the lawyers would look at your Joe collection as a serious asset.

It may be too late, but would echo the suggestions about firing up your b/s/t thread and living on ramen noodles for awhile if you can to avoid filing.

I think that outside of the small Gi Joe community, not many others would consider Gi Joes as a real asset. I have never assigned any monetary value to such. I would caution about following some of the advice on this forum instead follow your attorney's advice. Nevertheless, I would tell you that it is not a good idea to lie or mislead in a bankruptcy proceeding. Bankruptcy judges have an immense level of authority and if they choose to apply penalties for misleading the court, life could become much, much more complicated.

Man, so much sympathy/empathy here.
You know, I ised to be a judgmental jackholes who would say things like some of you have said. But I've learned, hopefully, that every circumstance is different and you don't know what brought about those particular circumstances. Sometimes, through no fault of their own, bad things happen to people. Sometimes bad things happen as a natural consequence of our actions, though. Nonetheless, I can see where the OP is coming from. I also see where some of you are coming from. I agree that what takes priority should be family and making sure they're taken care of first. But I also know how hard one works to establish a collection. My advice would be to sell everything that you can absolutely live without first. Do what you can to stay out of bankruptcy. Keep some of te Joe stuff that you have a sentimental attachment to. Also, as far as leaving things for your kids, well, personally, my kids don't give much of a care for GI Joe overall. I've tried to pass on some of my toys to them and they'd rather play with boxes, bubble wrap, sticks and video games. What they're gonna remember, though, is that I gave everything for them, including my time, and made sure they ate and had decent clothes.

This is really the idea. About 12 years ago, I could have filed bankruptcy but sold everything I had of real value instead. As a general rule, you will have serious credit problems for major purchases for about 7 years. In the past, there was a much greater stigma associated with declaring bankruptcy. It is a much more accepted practice these days, which kind of sucks. I know the majority or this was your wife's debt, but both you guys need to undergo some financial training. Hopefully a condition of the bankruptcy will be participation in some type of financial course. I'm not talking retirement planning but a class to teach you how to manage a monthly budget. The fact that you are worried about your Joe figures when you have a bankruptcy hanging over your head is an indication that your priorities are out-of-whack. I'm not trying to be a dick, but you did throw this out into the public forum for comments.

Sell your stuff (both of you) that you can (luxury and nonliving necessity items). Go through the bankruptcy.
Then get a divorce, or live together thinking as one, and more in sync--instead of thinking exclusively hers and mine and ours. If you both suffer in the pain of it then hopefully the second phase of your lives will be more smooth and not get out of whack. If you have (already??) or are just now starting a family you need to save more than you need Joes. IMO. Kids are expensive! If your income grows in proportion as you get older then start your collection again if you want so long as it is a mutually agreed upon thing. just my opinion.... If your Joes survive the bankruptcy and she loses her car or other things then she will come to resent your stuff (that's human nature)--that is a possibility. better to be rid of it now, and try to get it back later if it is feasible.

This is an interesting thread and I sympathize with the OP, not from personal experience, but because he is a human being who is about to become a father and rather than being able to focus on enjoying this time with his wife, he has this hanging over his head - whether it is his direct doing or not. I am far from being a financial super whiz, but I've had post college debt, have paid for most of it slowly but surely, still pay for it monthly targeting getting done with it this year, and understand the true temptation of credit cards. Rather than say "Don't have credit cards," which though being sound advice our society would be better off taking is sadly unrealistic for too many people, I'll say "Live on only 75% of what you take home as pay." Live beneath your means. Twenty five percent of your income could be diverted to saving/preparing for your retirement/investing for your children's education - even if it isn't much, it can become something long term. Often people have designed their lives to require 100% of their income or even more (hello credit). Restructuring your life to realistically exist on less income is a good lesson to master in order to teach your children. Good luck.

Man you people giving this guy crap about it are are hypocrites. If you were in his situation I bet you would not want to sell yours and avoid it if you could. The fact that your not makes it easier for you to tell him he is wrong. The lawyer will not think anything of your collection most likely unless you have a crapload of rare figures or prototypes that could fetch thousands.
