I think I understand you what mean, from a trademark point of view?
I guess Hasbro has lost (like many others) it's trademark of 'Stalker' so they trademarked 'Sgt Stalker'. If that runs out they can always use 'Lonzo "Stalker" Wilkinson' or some other variation. |

How does this work, does Hasbro actually own the copyrights to code names for a set number of years? Did they just forget to renew them or did some of them expire while most fo them didn't?
What does this mean in practice if Hasbro does have a copyright? That some other toy company or movie actually can't have a character named "Scarlett"? |

What does this mean in practice if Hasbro does have a copyright? That some other toy company or movie actually can't have a character named "Scarlett"? What happens is that, yes, after so long, trademarks expire. In the 80s, nobody thought that Hasbro would be making GI Joe toys named "Hawk" in even 10 years, let alone 30, so they would just let them expire. I'm pretty sure that you retain a trademark simply by consistently using it, but some of them you have to reapply for. (I'm not sure about this part's specifics.) So basically, Hasbro owns the rights to create toys named, for example, Snake Eyes. Nobody else can make a toy named Snake Eyes. And there's also some strange rules about them that are strange to work around, but apparently Hasbro's lawyers know enough to not get them sued by anybody. For Hasbro to lose that trademark, they would have to let it expire, which means not producing anything using that trademark for a set number of years, I think. It might be different depending on how long and how often Hasbro uses a trademark--I seem to remember Hasbro specifically releasing a lot of Transformers toys named "Prowl" and "Mirage" around 2001-2004 specifically so they could ensure they had those names "locked in," as Transformers names. I'm pretty sure at this point, Hasbro could stop producing figures entirely who are named "Snake Eyes" or "Cobra Commander" and still retain the trademarks for at least a few years. |
