If you are profiting, trading, benefiting or distributing an item that infringes on the likeness of a copyrighted concept, idea, product or creative work without the express rights and permission of the copyright owner you are in fact in violation of the aforementioned copyright. Will the copyright owner take the time and effort to come after you for violating their copyright? Maybe, maybe not. But if they do, and if your violation is egregious, they could take you to the cleaners if they wanted to make an example of you. If you are making a custom for your personal use you are fine. Bootleg implies that you have created a product that resembles or functions in a deliberate manner the original copyrighted item with or without the intent to directly market your item as the real thing. If I'm selling you a fake Rolex, and I tell you it's fake, it doesn't make the item any less of a fake (bootleg) just because I told you that it is fake.

Wow. I got lost in the first sentence. I don't want to mass produce for others, I just want a custom that l can use to look like the real deal in my cabinet.

Cast away. Make it or have someone else do it. As long as you don't try to turn a buck on it or misrepresent it to someone else you have not "crossed the line".

there is a fellow on ebay who makes remakes of cobra mortal, cobra invasor, de aco, and a whole bunch of others with that same mold. he has a few other different figs as well, i think he does great work, actually bought a few for my collection as i would never be able to afford the real version of these and they look exactly a like, they just dont have a hasbro stamp on it. i guess it is a bootleg but i dont see anything wrong with it because the seller lets you know upfront that they are not originals, so its kind of cool to be able to have something like this offered.

But Hasbro I am pretty sure still doesn't know how to get there wifi to work and hasn't a clue about ebay. So I could only assume its fair game.

As long as the seller clearly states that it is a replica - no problem, also I dont think making your own Dialtone out of Airborn and whoever else will effect the value of the original as much. As a matter of fact I think it would be a good option for openers.

Eh. Like DVDs, I consider a bootleg to be something that's inteded to look exactly like an official product, without disclosing that it isn't the official product.
Customs, to me, don't fit that criteria. Customs are still different than the official release whether due to paint or parts. I think such customs could be legally considered as art. In such a case I suspect the legal no-no would be mass producing the custom for sale, and then using registered or trademark names and backgrounds. What about the artists at conventions that sell stylized likeness of popular characters? Do they have to buy licenses to do that? I ask because I really don't know. |

I don't know but if they lie and say it is an actual hasbro product then it turns out to be a bootleg than that's pretty bad.If they are honest and tell you upfront that it's not authentic I don't see a problem.You aren't harming hasbro in anyway they don't make money off of ebay sales and they didn't even manufacture the brazil or argentina figure so either way it wouldn't effect them.
