then take a photo from afar as not to show the elbows, and bamm...you got money.

He won an item from me on ebay on a thursday ( Jan. 3, 2008), pays on a friday (Jan. 4, 2008) in the evening. I get payment and prepare package over the weekend. I mange to get all packages ( was a good day on ebay sold about 200 items) out on a wednesday (Jan. 9, 2008). Wednseday morning around 10am I was sending all my buyers info that I sent items out on wednesday. However, Wednesday morning around 5am Buyer files a dispute and asks for claim with 5minutes; without letting me tell him his item was sent out. I don't even get a chance to explain myself. Mind you the buyer paid for regular shipping nothing special no priority or delivery confirmation or insurance. I told him item went out and to please close dispute I uploaded a copy of receipt that item was sent to buyers address.

January 12th, 2008 buyer receives item and calls me claiming item was crushed and it took to long for deleivery so he won't close dispute.

The item was sent perfect in package when I sent it to him.

I can't help how it is handled over the mail.

Sunday paypal closes dispute and I loose $7.00 and item.

I been fighting for this whole month and i get from paypal - " sorrry we can't help".

WTF!!!

I am done with paypal and this seller is a jerk!

For all you sellers you better make sure you use a tracking number or delivery confirmation.

Well, technically you waived your seller protection when you didn't use Delivery Confirmation by accepting Paypal, which is required as per their Terms of Service. It sounds like this scammer was aware of this and consciously exploited it. When it comes to Paypal reviewing claims, as an employee explained to me on the phone, they first look at who is protected. No matter if it's an obvious scam, Paypal sticks to their policies and has to go in favor of the protected party.

In the future, always impose DC with all auctions, except those $250 and over, which require Signature Confirmation.

It's going to be wonderful starting in May when eBay implements it's new policy that all paying buyers must receive positive feedback. Your case is the perfect example where this outrageous policy is crap.
