did you pay via paypal? if you did,.. then you can get your money back by filing a complaint. if he cant get proof that he sent it to you,.. they will refund your money and charge his accounts.

Unfortunately it was too late for me to file a claim. No more pre-orders from eBay for me, they usually don't give you much time to file a PayPal complaint. After you wait to get the item in stock and then ship the 45 days is long gone. I'll stick with BigBadToyStore.com, they seem to have a very good reputation and good customer service. Their policy even guarantees delivery. |

This is why you should ALWAYS file the complaint after 2 weeks of non receipt. You can always cancel the complaint/refund process. But once the time is up it's up.
There are quite a few sellers who know just how long they have to string you by before they are off the hook. Also beware of those sellers who say they are sorry and will send you free stuff as a piece offering. This is a way to get you to delay and filing of complaints. I always file after the 10th day. If they respond and say they are sending, tell them you will cancel it once the item arrives. This way they either will send it, or know they are going to give back the money. Play it safe. 10 days, file! Knowing is half the battle! |

And just a bit of info for everyone's benefit, eBay's TOS prohibits the posting of other eBay members' contact information. Even if someone is a shady, crooked seller, if that was reported, it would be your account in jeopardy. That's something eBay takes very seriously, and they do suspend (sometimes permanently) accounts for it. If your seller also happens to read collector boards, or if someone doesn't like another of your posts and e-mails the seller with a link to it, you could end up on the wrong end of an eBay suspension. All we have to go on when we're deciding whether or not to place a bid is the information eBay makes available to us, so it's really not worth the risk on your part. Making the claim gets the ball rolling. If the seller IS shady, he will now have to give up, close up or cough up. BTW, I am referring to making a non receipt claim with ebay, not paypal. If after 2 weeks, then i suggest opening up a complaint with Paypal. I have been burned a few times and now I use all the tools ebay offers to prevent it from happening again. better safe than sorry. |

Whether or not it's permanent isn't the point. Most eBay sellers are doing it on the side, and some of them only go to the post office once a week. Another thing, a good majority of sellers on ebay have lots of stuff on, which would mean they do ebay frequently. If their auction states they ship once a week, then on that day, count 15 days. That is more than enough time to get something from one side of the country to the other. |

Do whatever you feel you have to do, but it's patently awful advice to give others, and less experienced eBay users need to be told it's bad advice. |
