alright guys, here's the quandary. I shipped out a Paratrooper SE's to a buyer, who refused insurance and only wanted regular shipping, not priority. when his package arrived, it was beaten up (he claims) and said he wanted a refund. he claims he only collects MIB items and now the item is damaged, which is fishy because my auction clearly stated that the item was not mint, so he probably shouldn't have bid o nit anyway. and if you are such a meticulous collector, wouldn't you pay for insurance and priority mail?
I hate the fact that the guy isn't satisfied and has been victimized by the Post Office, but he did refuse Priority shipping and insurance, and the package was packed well enough to withstand normal shipping, but obviously not getting beaten the heck out of. I understand him wanting his money back, but I don't think I've done anything wrong. where does my responsibility end and his begin for refusing to protect his item. I shipped it and it arrived, his problem I think would be with the Post Office but he refused insurance so he has no grounds to stand on with them either. what is a fair resolution in this situation? I already contacted ebay who seemed to agree with me and they told me if he negged me I can contest the unfair feedback, so that I am not concerned with. is he being unreasonable coming at me demanding a refund or restitution or am I being unreasonable placing the blame on him? demanding I refund or to compensate him somehow seems to infer he takes no responsibility on how and why it occurred and only I am to blame (if at all), and that just kind of rubs me the wrong way. that is just unreasonable, and all I expect of anyone in dealing with them is to be reasonable. advice. |

Technically, you're done, he didn't get insurance and something happened. Maybe next time he'll get insurance. However, this may not be the nice thing to do. If I were in your shoes, I'd first ask for pictures of the damage (Shipping box and item) depending on those pictures, I'd decide to tell the guy to get lost or possibly offer him a slight refund and remind him that next time he should get insurance

If he read your description and it clearly said "NOT MOC" and he still hit that buy button and is now crying boo-hoo? Then sorry about his luck. :(
On top of that, if he refuse the ins. and it got the crap beat out of it on it's way there and you packed it well? Again, sorry about his luck. :( Why can people not be responsible for their decisions and not look for someone to wipe their arse when things don't go their way b/c of their OWN actions? God, that pi**es me off!!! Anywho, I'd do this, offer to refund his $$ to him after, and ONLY after he returns the item to YOU. That way you are not out your item and the dough. Plus he gets it stuffed up his kiester on the return shipping to you which hopefully covers the damage to your item since it left your possesion and it's lowered value now. (hopefully it covers it if it's not completely FUBAR :( ) The other way to go about it is tell him sorry about your luck, learn to read and learn what ins. is and see if he leaves you negative feed back. If he does, then contest it with e-bay, explain to them the post clearly shows it is not MOC and he understood that before he bid, and then also show them that he was offered ins. and refused it. The he's totally jammed up, and if you go with option one above, you can also tell e-bay you gave him a chance to get his dough back already and he said no to that too, so what does he want, the item AND his $$ back too? No way Jose! Now I'd don't mean to sound like a jerk here, and I'm all for eveyone being fair about online deals, e-bay or no e-bay, but I also belive in "let the buyer beware" too. I guess I'm just more bitter than anything else b/c I just had some a-hole hang me out for $145 on a Sony MP3 walkman on a BUY NOW deal which I jummed on b/c it was a great price. Well, I get an e-mail right away that says we will ship as soon as possible, but "don't know when that will be". Huh? What's that mean? Then all of a sudden there is a second copy of the same item I just bought back up in their stores listing for the same deal? So I'm thinking maybe they've got to get enough of these ordered to get them at that price from their supplier? I don't know whatever, I'll give them a day or two to get me shipping info and not worry about it. Anywho, 3 days later I get a second e-mail "sorry, we lost your item and can't find it to ship it to you, we WILL refund your $$ but our Pay Pal account is having problems and PP has locked it and is investigating and we can not refund your $$ for 4-6 more days. WTF?! I sent them a message back and said, "No, BS, I paid you right away via PP and you had the $$ within min of me buying, I want my $$ NOW! Not in 4-6 days!!" So now it's "Were real sorry SIR, but we can't do anything SIR, please forgive us SIR, we're at the mercy of PP SIR, we've done all we can SIR" Basically a polite "stuff it pal". :( I wrote back and told them I wanted an answer by this Mon at 5:00 PM one way or another or "I" was going to contact PP myself. Beyond that I told them that if I did NOT have the $$ in 6 days time I would BURY them on e-bay and PP both if I can. So while your situation sucks, you're not the only one getting jammed up out there. :( Eric Joe Attorney and Council .

I think you did all you can and are completely in the clear. What if you mail off a ebay package with only a delivery conformation number and it goes missing? I am new to ebay and this is what has happened to me.
