I've only been using Ebay for about a year and I've never had any problems with the vendors there. I'm certain that some of my fello tankers are ebay veterans. Experience leads to wisdom, so I turn to you. Recently I ordered the Best of the 80's DVD battle pack for a reasonable price. Heck, I thought it was a good deal. Anyhow, a fe days pass and I don't get an email saying that the item has shipped. I decide to give it 2-3 shipping days before contacting the seller. After all, it says that the item may not ship for 2-3 days. This is just the first time that business day three passed without shipping confirmation.
So I dropped them a note, asking if the item had shipped. They replied that they had meant to contact me earlier but that they didn't. There was a problem with my order. Apparently the Alpine figure had a little paint on his torso that as not in the item description. So basicly they tell me that the item was in worse condition than described, so they thought they should contact me to tell me. I appreciated their being straight with me about Alpine, but then again, they didn't reach out to me, they responded to my question. Then he tells me that we can cancel the order if I don't ant the item. I think I still want the item though, as a little paint mark won't bother me. However, he goes on to say that if I still want the item, we can cancel the order and he'll repost it for the same price with a more accurate description. So, either ay we'll have to cancel the order. Here's my question. Is this guy right? If the item is not as described, and he tells me so, do we have to cancel the order only to initiate it again for the same price? If one was really trying to avoid trouble with ebay, wouldn't he have listed the item correctly or contacted me first? I don't know. That's why I'm asking my friends on the tank. A lot of you guys and gals do the ebay thing and you could probably tell me if this is normal or advise me on what to do. I have no reason to believe that this guy is less than legit, but I'm afraid to pass up this deal by cancelling the order. Any advice or comments would be appreciated. If the seller is a tanker, and you recognize this situation, maybe you can clear it up with a PM. Like I say, I'm relativly new to ebay and it's practices. Thanks! |

Thanks! there is no reason he should be doing this unless he's afraid you're going to leave him negative feedback since ebay is really making it hard for sellers in that respect. so to save his own ass he's probably doing this so that you can't escalate a claim against him. HOWEVER if you were to escalate a claim... ebay reads all the messages you've ever sent to a buyer etc/vice versa which maybe he's unaware of. THAT being said... it really is odd that he'd go through all of this. it's not normal. since you have already paid him... and a refund takes a long time through pay pal ... it sounds fishy. you might be better off being pre-emptive and opening a claim against him. i mean you have 30 days from purchase to do so... but if you pay and he cancels... you don't get your money back immediately and honestly since pay pal will be unaware of it (since there's no claim) he can take your money. i mean it's not that black and white but pay pal disputes can get really complicated. you definitely have an odd situation on your hands. I'd email ebay right away and explain the situation. cover your ass.

Thank you. It's good to hear that I'm not alone in thinking it was odd. I just didn't know. I was half afraid that we'd cancel and he'd up the price. That maybe he had second thoughts about the price or somthing.
I will follow your much valued advice and contact Ebay. I was afraid somthing shady would happen on there eventually. Still, I've had many good experiences there so far. Thanks again for your take on the matter. |

I contacted ebay and they were very informative. I was told that if I still wanted the item I should tell him and that he would NOT have to cancel and relist. So I wrote him another message basicly telling him to go ahead and send it, and that I would not leave him negative feedback since I was now fully aware of the condition of the item.
Haven't heard back from him yet. Granted, it's only been twenty four hours but I can't help but wonder if this guy is legit or not. He does have positive feedback but buried deep in the feedback there are a few complaints about complications and ethic. Of course he responded to all of those and called the feedbackers liars. That doesn't bode well. I guess I should be seriously thinking about filing a claim. Maybe I'm naive but I'm still holding onto hope that he has the item, it has a sloppy paint mark, and he's just looking out for me. Hoping at least. We'll see. |

I think he is disappointed in the price it ended at and is hoping to relist it for a higher final bid. No matter what he ends up doing, you can still give him a neg if it doens't turn out right for you.

I think you have a good point. If we cancelled the transaction, he'd totally be able to relist at a higher price. I'm inclined to agree with your impression, and if that's what he's doing, that just pisses me off. I kind of thought, what if he sends it after all of this, and it doesn't have a paint mark on it. That would be telling.

just leave him negative feedback and file a complaint. escalate it to a claim asap. sometimes if you escalate it to a claim you won't be able to leave feedback. so if you wanna get all gung ho you gotta leave the feedback first. heheheheh. get your refund. add him to the bad ebay seller list on the tank.

I'm always a little worried about just leaving negative feedback. I just assume that they'll do the same to me, and we'll both be worse off for it.

I finally heard back from the seller after sending him a message saying that I anted the item still, and understood it's condition. I explained that Ebay support informed me that we would NOT have to cancel the transaction. Even so, this as his reply....
"I appreciate your message. Just so I understand, you would still like the item, correct? If you do, I need to do it the way I explained in my last message. That is, refund the first payment, cancel that transaction, relist it with an accurate description for the same price you paid, and have you win that one. I'd list it at a starting price of $54.99, make it clear in the auction that it's for you, username "belhorn77" and that all other bids would be canceled should anyone bid, then when you placed a bid at $54.99, I'd end the auction early with you as the winner. I appreciate the sentiment you've expressed that everything is copasetic as-is, but for my peace of mind, and frankly just to make sure everything is 100% legitimate in the transaction, I need to do it the way I outlined. So, please let me know if you want to do it the way I described." I told him no. I urged him to ship the item. Well, here was my response..... "As I stated earlier, I have been in contact with the Ebay live support. I didn't drop names. They explained my options and were quite clear that if I maintained interest in the item after being appraised of it's updated description, privately or publicly, I could expect you to honor our agreement. You might say that we don't have an agreement since you prefer to cancel and I do not, but in fact we did have an agreement and you have altered that. Now you've asked me to do somthing that Ebay has told me I don't need to do. It is my sincere hope that you ship this item as soon as possible. I feel as though my request is reasonable and I urge you to reconsider your position. Please respond as soon as you can. Just let me know if you will ship the item or not. It sounds as if you're saying no. If that's the case, I suppose I need to know." So I don't know. He was still listing items after this last back and forth but he didn't get back to me. Does his argument make sense? I am being too paranoid? |

His request makes no sense. When you win an item the Buyer you and the Seller him are engaged in a contract if he tries to force something he is braking the rules. So sounds really fishy to me I would contact eBay and forward that message to a eBay representative.
