I bought an item on eBay via Buy it Now with a best offer. The best offer I made was countered with another by the seller, in the end I got $10 taken off the price. In total the item cost $82. The item was listed in the title and the description as being sealed and never opened. When I got it, it was of course not sealed.
I e-mailed the seller about it, and let him know I was disappointed to find the toy not sealed. He has not answered yet in the week since contacting him. I paid a lot more than I would have had I known it was open, in fact I have an unsealed one that I only paid a total of $35 for. The problem here is that I want the toy, but I think that it was pretty crappy of the seller to list this as sealed, and then not bother to reply back to me after I got it and found it wasn't. What would anybody do in my place? I doubt he is gonna respond to my initial e-mail at this point.

I would complain as well. File a dispute for "condition other than described."

Give it a couple of days, if he doesn't respond and you still feel raw about it threaten him with negative feedback. See what happens then.

On e bay with pay pal the buyer has all the power. I would(and have in the past went after ebay sellers who i feel have done wrong) i dont think youcan keep the toy and get you money back like orthers have claimed i hope you do but its not likely.

Were you going to keep it sealed or open it? If you were going to open it anyway, then I would say drop it.
If you wanted to keep it sealed, then file the paypal claim and hopefully he will respond and make it right with you, otherwise paypal will make it right with you : - )
