First, filing a claim is a very serious issue for a seller, and what you were doing is filing a fraudulent claim. What the hell are you asking for? To have an item sent to you for free? Because filing a claim will not force him to accept your money. Second, after he refunded your money and explained the situation to you, you responded by basically calling him a liar. Now what the hell does this solve? If I was in his situation, and I had honestly made a mistake, and you come back and call me a liar, I'd tell you to fuck off too. I don't have it, you can bitch all you want and it won't change things. Now if he is lying, what is calling him a liar going to get you? Still nothing. If anything all it can do is sway whether or not you want to leave bad feedback, which is the only thing you are entitled to in this whole situation. That's actually a pretty powerful thing to have against a seller, and again, shouldn't be used lightly. Ebay is one of the only forums on the planet, where a couple of pissed off buyers can ruin a seller's livelihood. I read through this story and didn't see where the seller did anything wrong (except for maybe responding "unprofessionally" on the second reply; the first reply was extremely courteous, informative, and professional in my opinion).

I don't know that a mistake gets a guy caught redhanded. He may have created the auction like he said and then just posted it here... If he made a mistake he made a mistake.
I can understand your dissapointment but your response to him called him a liar and you have zero proof. He offered an airtight excuse for his mistake. You don;t know whether the cart came before the horse or not and its an easy mistake to make, especially if you have ever sold on eBay and had to go through the process of setting up an auction. I'm not saying you didn't but it's nice to be able to have a shortcut. Point is, you don't have anything reliable other than you think a post here on the Tank is undeniable proof that a guy is lying to you because he wants more money. He was polite in his response to you. He refunded your money and peft you positive feedback. If he didn't care, as you proclaim, he wouldn;t have bothered with anything other than the refund. Yet here is a seller who tookt he time to write to you why in a nice way and give you feedback for your trouble. This just seems to be more a case of a pissed off buyer who clearly believes that misery loves company. Opening a case on a guy when you have no way to proove that his actions were fraud? eBay has no way to proove it and will do nothing against him. They will see his response to you and refund. End of investigation. Accept that it's a no go and move on. Besides, this guy is on the radar now, which is unfortunate. Publicly calling a fellow tanker out is rough deal. If he does try to resell the parts, people will question. But I have seen it done here before. Tankers calling another tanker out because they don;t like something... you can ruin a guys reputation and that is a terrible thing, especially when you have nothing to go on other than your own dissapointment.

I'm sorry but isn’t it the sellers responsibility to make sure that the things they put on eBay are accurate and on hand. This buyer has every right to be upset this is the equivalent of false advertisement. This is the same as someone labeling something as MOC on eBay that is open (I hate that)

That's the point here...he was lying and deserves to have his account yanked. There are enough nameless/faceless asses on there so if you can identify a jackoff-go for it.
