Or maybe you are trying to drag custom figures (which aren't in trouble) into a battle over repro stickers?

For example, I make a painting of Destro dressed as Mary Poppins for my cousin - who happens to be a mary poppins and destro fan. As there is NO competing product being put out by Hasbro or Disney that even remotely resembles this, so it wouldn't be cutting into any sales, and I'm making ZERO profit from it, I see no legal reason this wouldn't be allowed. You could even argue it as satire, which is protected to an extent legally. |

no, music industry has clearly already pulled out its dildo and attempted to screw fans of music in the bum.
I purchased the album, it is mine, i own it. Yet somehow some musician performed some legal jiu-jitsu and now all of a sudden even though I paid for and possess a copy of their music, it STILL belongs to them. As far as music goes, if you're not allowed to own it and do what you want with YOUR purchase, I say why bother. As for Joes and action figures, there has never been a high-profile law-suit like that, and I hope there never is because that would RUIN action figures for about HALF of us. If you buy a stock Chevy and customize it, is that illegal? Absolutely not. There are limits if one wants to keep the Chevy road-legal, but cuztomization is in no way illegal. Selling custom cars is not illegal. As far as action figures go, there's no way that you can customize something too much until it becomes a danger to yourself and others, so there should be ABSOLUTELY no limits on customizing toys. I fuckin swear if America makes a law against CUSTOMIZING TOYS we would be the country with the WORST friggin priorities. I would like to see a link that supports the theory that customizing is illegal, because that just sounds absolutely ludicrous. Im'a google it too. |

Reselling is legal because the company that made it already got their money. When you resell it you are not hurting their chances of selling something to someone else.
Now, if you buy a Marvel Universe figure and turn it into Superman, you are hurting DC/Mattel's chance at making money off of the property they own. Now, customs are such a small market that when someone does a one off it just isn't really worth their time to try and stop it. However, if someone came up with a way to produce them at levels that could affect Superman toy sales, then Mattel would definitely go after that person. What this should do is incent producers to stop making shitty figs instead of throwing resources at the legal system for some guy pumping figs outta his mom's basement. Hell either add him to payroll or step up your own damn game.

I found this link right away. unfortunately it sounds like we're both right. Customizing is illegal if you make too much money, but it's so non-important that nobody really cares. That's total BS, i think. It's like saying you can buy this lumber, but you CANNOT make whatever you want with it, you can ONLY make a bench with THIS lumber.... idk, i'll never stop customizing (or, once I get back IN to customizing, I'll never stop again), until the law says my toys are ruining society. lol this subject makes me angry ha |

Go ahead and not read this next part because you are all going to ignore it anyway.... I do feel that customs are next becasue of my problems with stickers and the point of the initial thread was to warn customizers who sell.....that's it. The point of this thread is to ask people how they feel about it...legal or not....or it should be legal.....is it a crime to get a consensus these days? Why the everyone trying to start a fight with me over this shit? Be FN respectful human beings....you DO NOT want me to start thrashing people publicy.

The Lincoln Log people own the copyright/patent on that shape of wood toy (they have been around a long time though, so they might not hold the patent any more, but that's neither here nor there) and you can't profit off of that without their permission. |
