The actual law, in section 102 to be exact, states that every manufacturer must certify that their product has been tested and doesn't contain more than the acceptable lead limit (600 parts per million for the first year). This only applies to products manufactured after the law goes into effect. So basically this only effects companies like Hasbro which manufacture the toys. The part that everyone seems to be concerned with is section 216, which prohibits the sale of banned items (including toys with too much lead) or recalled items. As a seller on ebay or at a convention, you don't have to certify that the toys you are selling comply with federal lead limits, but if they do have too much lead or have been recalled, you can be penalized under the law. So, if you are 100% confident that your Joes have less than 600 parts per million of lead, then sell away. The real losers in this case will be the second-hand stores like Goodwill. How can they be sure that the plastic horse that someone donated complies with the lead limit? How can they be positive that it hasn't been recalled? They can't. And with fines up to $100,000 per violation facing them, I'm betting that many will simply choose not to sell donated toys. So I guess the bottom line is that we as collectors and sellers of Joes don't need to worry too much about this law, unless we regularly shop at second hand stores for them. Toy Health Inspector says with a grin "well I see, we will need to bring you in for further questioning, you may want to get a lawyer". It is also a good way for the incoming administration to save face by not pissing off the Chinese of telling US companies to bring it back here instead of there. This law lets things happen naturally by having the companies make that decision. |

I wonder if there are additional laws that protect sellers of not knowing a product was leathal. Like antique stores could have items that were stored in places with asbestos or other hazardous chemicals an dhav eno way of knowing it. Maybe once an item is doen an docnsidered "antique" the buyer chooses to responsible for anything bad that may come from the purchase and the seller is selling the item as is without liability?

My comment about Joes was in reference to the random rants about "BUY AMERICUN TOYZ" - when those of us in this fandom haven't been buying "American" toys in decades.
But yeah, that PDF says that the only toys that will be illegal to be sold are those tested and proven to have too much lead. Only toys manufactured after the date of Feb 10th will be tested. If it was manufactured before that date, it cannot be tested therefore it cannot be banned by this law, unless it was already banned under previous law in which case it remains banned. Savvy? |

For example, there were rumors some years back about Funskool joes having high amounts of lead paint and being unsafe. Was this true or ever tested, probably not. So can I sell funskool toys now or are am I potentially libale under this new law? or does it only apply if they have been placed on a recall list? Exactly! That's why second hand stores will probably stop selling kid's clothes, toys, etc., because they cannot determine which donated items are safe. But this should not affect Joe buying or selling, at least on ebay or at shows.
