From Wikipidia, I gathered some of the following:
"The Consumer Product Safety Improvement Act of 2008 was a legislative bill known as HR 4040, sponsored by Congressman Bobby Rush, and signed into US law as Public Law 110-314 on August 14, 2008 by President George W. Bush. It is targeted mostly toward "children's products", which are defined as any consumer product designed or intended primarily for children 12 years of age or younger. The Act imposes or increases both fines and jail time penalties, increasing criminal penalties for various prohibited acts to incl"ude forfeiture of assets and imprisonment for up to five years, and eliminates the requirement that the CPSC first notify of noncompliance before seeking criminal penalties." This evening's televised news continues coverage of South China toy factory closures, riots, and failure of the Chinese government to hide the discontent of unemployed toy factory workers unable to feed themselves now. (No word if Hasbro is affected) Even though me E-bay shopping days are over, at least I can still feed my family. God bless the USA, but not the 110th Congress. |

This is Un-Enforceable!! WTF. Thats like saying its Illegal to have a free market society! This will not fly and if so, I say we raise our voices and stop it. This is socialism at its might! Power to the people.
Yeah, some think it sticks the scalpers but honestly, my wife has for the last 9 years resold my daughters clothes and uses that money to buy more clothes. There's no Effing Lead paint in them!! Now, she's a criminal for being financially smart??? WTF. I looked at the CPSC website and don't see anything about this. This is pretty big news if they are hiding it. I say we contact them. Here's the site. Ebay lists this site everytime you sell a toy so you can be aware of recalls. (Moderators: Do not prevent this link) http://www.cpsc.gov/index.html We have the right to buy and sell our toys. Personally I don't think this will stick |

I can tell you if you thought the economy was bad now, try wiping away a Trillion Dollar chuck of that economy. Toy collecting goes beyond just action figures. It goes back to old model trains, hot wheels, dolls, barbies, games, teddy bears, trinkets and bobbles.
One thought: Prohibition of the 20s and 30s. With the trouble that caused they rebuked that law and that was a constitutional amendment. |

I do not know if this was posted yet (sorry if it was).
This is the actual bill of law from congress in PDF format. http://www.cpsc.gov/cpsia.pdf As a retailer it doesn't seem horrible. Basically I just have to place warning labels next to anything and everything toy and/or game related....fun....what a waste of time....but it could have been worse.

I'm a retailer too and business person myself. I'm reading this and someone please correct me if I'm wrong, this thing doesn't say all child products for resale are illegal. It states reselling child products that have been marked for recall or contamination. I'm still reading this bill but I think the media source blew this out of proportion like the media always does. I'll have my lawyer look it over as I had no idea this bill was even written. |
