But seriously, Judges in England and Wales applying their common sense and knowledge of legal precedent. That is what English Common Law is about. I am sure I can give you a longer explanation but you can Google it. You seem intelligent enough to research it yourself. Secondly, if you are trying to imply that there is no connection between common law and "right and wrong" then you are just being dense. Mayhaps I overestimated your intelligence. |

The first part was a joke...... it was not really meant to make sense at all...... just a joke.
Now what you want me to say is that laws are based on Morals. Yes there is truth to that but that is simplifying that you would agree, correct? Our laws can be traced back to early man in the caves in which we learned that even then there was a belief system, law or moral code where if you stole from another man you get clubbed and the collective felt it was justice.! Fast forward to England where morals were in full bloom ande breaking the moral law was punishable by death. That is unless you were a King or of royal blood where you could kill, steal and rape under the guise of Law and morals and then it was fine! Need I even go into if you were of color your rights to be treated with any sense of moral justice was thrown out the window and hell that lasted right up until the civil law. Did laws come from a moral belief system, yes......did those morals come from common sense judgements made by tribal leaders before there was even religion......most certainly. But again that is so simplistic in thought. We are in the year 2009 where morals of one set of individuals have been side tracked for a fair and balanced legal system that betters every person, not just the white men and what they want! |
