Heres the deal, I'll try to be as to the point as possible, but unfortunately your gonna have to read a bit to get the gist of this, here we go.
A few of you know this story..around last Memorial day, I quite my job and fell hook line and sinker for this plan a new friend had to start a building maintenance company. He already owned a flooring company, and I have a little side business of cleanouts and demolition. It seemed good..I fell for alot of smoke and mirrors, and just really made some stupid, gullable mistakes that cost me alot. Ok, I posted the lessons and things I went through already, short version...incredibly bad life changing experiance, lesson learned. Feb 3rd was my last day of work. I had shoulder surgery on the 27th and will be out till the end of August. I never got W2 forms, you have to understand when I jumped ship I worked for him on the books from June 1st to Feb 3rd. Part of me falling for it, was that I never became a partner just his employee. A very hardworking one, trying to pick up the pace for his shortcommings and make it work, PLUS had my own side thing going. Working for him alone I put about 50k on my Jeep, had no day off from memorial day-labor day and just went broke, and literally broke myself in the process. Today I get to the accountant (cant drive yet due to arm) and present everything to her. She says "you only made 2,000 dollars?" I said what do you mean? she said "this w2 said you made 2,000 dollars working for him, the big form is this 2nd one he gave you saying your a private contractor, its a 1099"...I said wait I'm NOT a private anything, I was an employee! I own my own business as well, I do my own 1099 for that! She said "as of now, you owe about 2600 to the IRS"...I said wait wait wait, pulled out every gas, repair, tool, and every other receipt I could find, explained the mileage I put on my car and we were about even. But still not getting anything back for all the money taken out year round?? (Plus I was hoping on taking like 500 bux for toys and comics and banking the rest, so the sinking feeling set in!) After that I said you can check these too...I handed her every stub from June-Jan..and she said "where is this money? you were taxed all year long and got a 1099??...this is illegal, your money was never given to the goverment!!..I highly advise you to call this person, and we'll let the IRS know whats going on here, you have aloy more owed to you". I called my old boss and he didnt answer, I get the bullshit payroll guy. I said Ron, why the FUCK am I on disability and having to pay 2,600??? He said.."we never paid payroll tax, the money taken out of all your checks never left the company, your yelling at the wrong person, call his cell".....After thinking about this, I'm thinking, wait..this guy is drving a late model Vette and crying the blues about money, plus he fucked me the whole time I'm there...lightbulb goes off.....he lied, he pocketted all my money!! I didnt call him because I wouldve just went nuts, after calming down, and finishing with the accountant, my receipts alone got me a nice little return. But they said from June-Jan there is over 400.00 taken out of each check, thats unanswered cash..a part of me wants to walk away and wash my hands of this, but another part wants to get what is mine and see this asshole get the fines and everything else he deserves. I am stupid enough to heal, meet him at the gym and use his face as a punching bag, its almost happened before, but the adult in me knows nothing good comes there..just call the board of labor. Now for the fellow Tankers..taking in all your ideas, this happened in NJ btw...what should I do in this case? |

Seriously, that's a serious lawsuit and probably criminal charges to go with it on his ass. |

This involves the IRS. If you are aware that the government is owed tav money and say nothing you could get accused of being an accessories to tax fraud. The IRS are sharks. Protect yourself. Notify the IRS and then talk to an attorney about sueing the ahole. |

Bigdaddy's right. It's not just about lost money. The last thing you want at this point is him pointing the finger at you if the sh*t hits the fan.

leave out the bit that you were 'suppose' to be a partner. Don't lie about it, just don't mention it. Since you were never taken on as a partner, its not your fault. But it can create more hurdles for you trying to be buddy buddy with the IRS person.

Whoa, Whoa, Whoa, Whoa, Whoa, Whoa,Whoa, Whoa, ... this is NOT my Batman cup! All jokes aside, This A-Hole owes you AND Uncle Sam? Well, I'm not a genius or anything but right about now, I would naturally assume that the government is having economic difficulties (both here and in the US) so if there is any chance that there is $$ owed to the Government, I'm pretty sure that they will make him pay... If it's brought to their attention, which is now up to you. Seeing him lose his car and have his life fall apart while you get a sweet tax return will definately have a longer lasting satisfaction for you than punching his lights out. Besides, if he goes to jail from all of this, then he might still get that punch in the head, among other unpleasant things. Just my point of view. I mean if you had a choice to hurt someone mentally or physically. Just remember: The body heals relatively quickly when compared to your memory.
