(this is sort of just me venting I was kind of upset about this)
Hey guys, I was in a small car accident the other day. Was making a left turn then an ambulance came so I stopped part way through the turn to let him through, but the guy behind me (white, probablly in his 40s) in a black volvo ended up hitting me in the back (mazda 3). When we viewed the damage, I saw several scratches, wasnt too bad. I asked him whether he wanted to go through insurance (ive been in his situation before and Ive gone the none insurance route and was very accomodating to the other person and assumed it was the "nice" thing to do for him so his inssurance doesnt go up), he chose non insurance. Here I was stupid and didnt take his insurance info, instead I just got his name and phone numbers. So we went to the body shop a few days later and had an estimate done. He notices that one of the small lenses was cracked near the impact zone, and was going to add it into the estimate, but the jerk who hit me went "Hey I didnt see that the other night, I have no idea if that was broken before or not" that sort of rattled me a bit because its pretty obvious that it was due to the impact, especially when i never got hit in that area. The mechanic took an estimate without it and came up with $350. I agreed that he would pay that amount but I made it clear I was uncomfortable with the issue with the lense. When I got home, I thought it over and decided that we should go ask the mechanic whether he thought that that lense damage was most likely due to the collission, so I called him to discuss that. He started acting like a dick, and we couldnt agree on the lense issue (the talking mood was heated), I told him then that since we cant agree on this we can just move it to insurance so they can just handle it. Then he refused to give me and insurance information, and said he talked to his insurance company and said he was not liable for any of the damages to my car, I asked him "why", and he stumbled for 2 seconds and said, "because when I talked to my insurance company, they said the police dont bother with these small things, and that these are just left by the owners of the cars to fix their own". I was angry at that reply and told him I have his name and phone number and that was enough to get the insurance info from the police. Then he went on this tirade about how he agreed to already pay for "most" of the car damage. I finally decided to say bye to him and call the pollice but I then decided to just call the mechanic and ask how much the lense would cost. About 50 bucks. I decided that it wasnt worth 50 bucks so I just phoned the jerk back and said fine you pay the 350 and that will be that. The mechanic, God bless his soul, sort of took pity on me and would fix the lense for free. I have to meet this asshole one more time at the body shop next week to settle the 350 and the non-liability waiver. I know that I was stupid on so many levels and I learned lessons. One I should have got his insurance right away. Two, I should have never agreed to $350, I should have said I agree that you pay what it costs to fix my car (its leased btw so I had to get it fixed eventually). Three, I should NEVER trust the other guy or he will just take advantage of my good nature. I am admittedly a very nice guy I feel for others, and sympathize and empathize with most people. I thought I was doing him a favor by not doing insurance, I was wrong and I almost got kind of screwed for it (thanks to the machanic I dont lose any money for his shitty driving, and imagine if it was mroe then 50). I know it sounds stupid but this really upset me (mainly b/c of the heated argument we had over the phone), but not because of the 50 bucks, but because of the principle. HE hit me and hes just looking out for his own ass and looking to cut fixing the wrong he did to me. It makes me really angry about my good guy nature, and that there are so many bad selfish people around. I guess Im too niave, I hate that about myself and am as upset about that as how that jerk actted towards me. Funny thing, he lives on the same street as me 50 houses down. Sorry, Im pretty much blowing off a bit of steam here, any comments or even jabs at my stupidity (I know I was stupid in this situation, was my first accident where the other person was at fault) are always welcome

You handled that too nicely. When I got rear ended first thing I asked was how f#$%ing stupid they were. He wanted to not get the police involved but ef that. Found out he had an expired license. It is not being rude to ask for the insurance, it does not mean you are going to use it. They can say that you did more damage after the fact though if you don't take care of it with to po po immidiately. Sorry to hear about that.

Eh... you weren't being stupid, accidents are annoying and you were frazzled I'm sure. Now you know for next time. The other gentleman should have been more than happy just to pay the $50 for your lens. I'm pretty sure you saved him from getting one maybe two tickets. The police probably would have given him one for unattentive driving. Rear-ending someone almost always gets you something like that.

We call people like that litigants
Watch People's Court and you will see that 99% of the accident cases occur just like this The Judge ALWAYS says to call the police and have the report filed (they have to anyway since it in on a public road) and then talk to your insurance company. If he is found at fault, he will also have to cover your deductible plus damages. Sorry to hear about you having to deal with all the crap |

In California you are required to carry proof of insurance and also required to exchange the information (auto insurance info, driver's license #) if the other person involved asks for it. This is a perfectly good reason why. Always go through insurance no matter how small the accident is because you never know. Sorry this happened to you.

ya i definatly learned my lesson, it just burns me that I could have avoided it by just being "a nice guy". I know he will get his one day, so i can take solice in that.
