i went to target at 6am on friday and it was like they were handing out food for the starving. people were nuts, pushing, shoving. i high tailed it outta there.

Notice that they are are including EVERYONE who is belived to have some responsilbity in this matter. While I suspect most of these defendents will be dropped, they are going to go after whoever has the deepest pockets. In this case, Wal Mart.
I am surpirsed that they did not name his temp agency as a defendent as well.
Sounds like her was a BIG guy too. Given the alleged size of the crowd, he obviously did not stand a chance.

How the fug do I go to a Slipknot concert at the Electric Factory in Philly, which is basically one giant mosh pit, and yet whenever I saw a person go down there were hands from at least five of the drunkest, scariest people you could ever imagine helping him (or her) to their feet before they even hit the floor, and yet someone dies at Walmart as a result of these so-called normal people?
There's my obligatory comment on society, here's the one about corporate responsibilty. I'm sorry, I know how litigious our society has become, but the fact is that there is something under NY State law called "depraved indifference". Basically, if you create a situation where fatal injury or death is likely outcome (stealing the life preserver out of a boat which causes a drowning that might have been prevented), then the person can be charged with murder in the second degree. A better example; if you fire a starter pistol that causes a cattle stampede and someone dies, or yell "fire" in a crowded theater. If you create a situation where 2000 people are likely to stampede with no police presence, no security, no crowd control, no way to manage the crowd you created, then turn them loose in a race through a bottleneck, then yes, you should be held just as responsible under the law if someone is injured or dies. I doubt if criminal charges will be filed against Walmart along with the civil action, but in my opinion they should.

I urge Every Tanker next year, pick a store and go on black friday and help PREVENT a tradgety like this.
i went to best buy to get a PVP for my wife and ended up escorting a little old lady around so she could get her blu-ray player for her grand son. the way that store was she could have been easily the 5th death from black friday.

I was just back at my local Wal-Mart where this tragic turn of events took place. I was not there on the day this had happened and this was the first time I was there after it had happened. I've been traveling to other Wal-Mart's lately instead of going there because I just felt creepy about it. As if to say that shopping at this place after someone's untimely demise was just wrong in a way. I sort of felt as if I was supporting this store by shopping there again. Then I thought of so many other circumstances where something similar had happened and eventually I got over it and went back to not even giving it a second thought. You know like going on a roller coaster ride a few months after someone died on it. That is something that the family and friends of the person who lost their life might not ever to be able to do, and I can't say I blame them. If I felt weird about shopping there ever again then just think how they must feel about just going on with their lives.
In any case I just wanted to let everyone know that there was a little memorial set up there with pictures and candles and other things right inside the main entrance next to the sliding doors before you enter the rest of the store. That really hit me because it gave you a glimpse into that person's life seeing a bit of who they were even though you never met them.
They now have these special security personnel there that look as if they are part of the SWAT team or something. A little too late if you ask me, and as far as I'm concerned they are not needed on regular shopping days where people are not busting down the doors. It's really just overkill and in some ways just makes Wal-Mart look worse because they didn't have these type of guards in place on that dreaded day. Then again I've been at this Wal-Mart before when the fire and police department cleared out the store for one reason or another. That was pretty eerie.
All in all it's very sad that it has to take a loss of life for people to wake up and realize what they are doing is wrong., and when I say this I'm talking about the way Wal-Mart and other retail chains handle their business. Sure it's not really Wal-Mart's fault, it's the human beings who turn into mindless savages when there are sales like this. The problem is that people won't change their habits because of this. I bet that people would do this again somewhere next year and the year after that. It is happened before this year so why not again. Since people won't change their habits I guess it has to be up to the retail chains to change theirs instead. Give out tickets for the sale items. Or maybe only let in 10 people at a time, wait a minute and let in 10 more people. Sort of the way you see things done at a club where there are bouncers.
I just want to say that my heart goes out once again to the family and friends who lost a loved one that will now not be there to celebrate the holidays or anything else for that matter ever again.
