Its actually not. I have had this happen twice in the last year. The 1st one I just let go because the seller did refund me before the not as describe case was closed. I still felt the neutral feedback was warranted. The 2nd time I left negative feedback and ebay pulled it dispite the fact that I had clear evidence that the seller was trying to pull a scam. When I calledto complain I was told by ebay that the negative feedback was not warranted because I ultimately received a refund and this could have been a honest mistake. Which is absolute bullshit. That one pissed me off as I lost the case originally and I had to really work to get evidence that could have put a fiends postal Job at risk.

I had a similar case with a scammer on Ebay. I bought a "factory sealed" MASK Switchblade from a seller (kung_fu02). When I got the package, it was put in a box that was way too big with insufficient packing. The shipping box was crushed on one side, but the switchblade looked to be fine. However, the toy was not factory sealed. The box was double taped and the bottom layer of tape was cut. I returned it through the UPS Store because it was no longer factory sealed as described in the post (pictures didn't show the double tape). So when the seller gets it back he opens up a case against me because it was returned "damaged". I messaged the seller and told him that I didn't think it was damaged when I got it and told him how I received it. I told him that it arrived that way in a box that was way too big, was crushed in shipping and his insufficient packing job was the reason any damage occured. He said that I should have opened a case against the post office! Ebay sided with him and I only received half of what I paid as a return. I opened up a case and won the entire amount I paid. I left negative feedback for him and it was removed after 2 days. He was the most frustrating seller I have ever dealt with. He deserved the feedback I left and should have been booted from Ebay.

Man, that sucks! Ebay is way too protective of its sellers. Both of our negative feedbacks should have been allowed and might have saved some other buyers from these dirty sellers.

eBay makes more money when you buy stuff. If they refund and seller gets dinged, its like a double loss for them because people are less likely to buy from sellers with bad feedback. Fraud, to an acceptable level, is just part of the business to them. “It’s not personal, just business.”

I've always felt that they favor the buyer too much. I both buy and sell, and when I'm selling, I always do so knowing full well that if something goes wrong, I'll eat the cost in the end, and I make sure I retain enough to cover return shipping at all times. Remember the good ol' days, when buyers were also subject to actual feedback? Now they can act with damn near impunity.
I'm not commenting on this specific situation, by the way, just saying that in general, sellers are WAY more at risk of getting hosed. All of that aside, the willingness on Ebay's part to remove feedback so easily has got to be a part of the last update to their TOS, in which "new protections for sellers" was mentioned. I should look into having my single neutral removed- it was left by a first timer that failed to read about the wear on a controller, and assumed I was Gamestop or something. After the sale: "What other colors do you have available", etc. I knew it would be a hassle before I even shipped it. |

So yeah, all in all, it;’s been a great buy. It wouldn’t have been a great buy at the price it initially commanded at the initial auction, but at my price it is, at least in my mind. I think the tape deal certainly harmed its value, but i can attest to its being a great item and a MISB one in my opinion. Incidentally, even though AFA wouldn’t grade it, CAS would have graded it with a ‘Q’ qualification, for the presence of double tape. Anyway, hope this settles some of the mystery of this Mauler. |
