I think the law would make a clear distinction between someone selling used goods out of their garage twice a year and someone who regularly buys and sells something.

Don't know about where you live but In Columbus Georgia ( not sure if it's state law, or a city ordinance) If you purchase NEW good with the intent to sell it, you're a reseller. You need a liscense. If you Purchase USED goods with the intent to resell you need a " Used Merchandise Retailers Liscense" If you're joe average clearing out his attic/basement/closet/whatever and having a garage sale you're fine. If you have MORE than two garage sales in a 6 month period you need a Retailer liscense( My neibhor was fined by the state for NOT having a liscense and having a garage sale 4 weekends in a row, never told me how much he was fined tho) I'm not sure what the laws are pertaining to selling on e-bay. I THINK that becuase it's an international "for sale" section it would need to be federal regulations, and there are not any, YET. Mark my words, however, given enough time there will be.

Think of it this way, Running stopsigns is illagal, and so's running red lights. How many times have you done it, and gotten fined for it? Exactly. |

That's not even close to accurate. Again, why would you persist in spreading bogus information? No state in the union has a law on the books preventing you from selling your own personal property, and once you buy something at a store, guess what it is? It's your property. You need a license to operate a business, but listing auctions on eBay does not qualify, period.

It's sketchy. I think it largely depends on the area in which you live. Also, if you operate a "weekly garage sale" it allmost constitutes having a storefront, Especialy if you are selling NEW products at the garage sale ( Happens ALOT in Phoenix city Alabama, across the river from me)

Just like everything here if you dont know for a fact dont state what you think to be fact without proof. I know here in WI you do not need a license to sell stuff on evilbay. If you buy 15 cases of something and sell them on evilbay you do not need a license. I have talked to officials here and they said you do not need one as an individual but in the long run it may be beneficial to get one.

A "Reseller's License" is something a business needs in order to buy goods at wholesale prices and avoid paying sales tax on them.
When Joe Ebaysellerdude goes and buys 10 figures at Wal-Mart, he pays the sales tax. The state is satisfied, because it gets its cut. Wal-Mart is satisfied, because it moved merchandise. Those figures now belong to him. He absolutely can go and sell them on eBay. Neither the state nor the retailer have a claim on them anymore. He probably does need to report the income he makes selling those figures on his tax return, but that's a whole separate issue. As far as getting licenses to sell on eBay, well, if you're running an auction on consignment shop...i.e., people bring you stuff, you list it, sell it, take a commission, pass on the remaining profit...yes, you probably do need a license depending on the state. But regular Joes needn't worry about these kinds of things.
