How would the average female checkout person have any idea what's supposed to be in the box?
Since TRU now requires driver's licenses for returns, they should be able to investigate who actually did that return in their computer records. I'd point it out to them and see if they can get his identity that way. Problem is what happens if the guy claims it was like that when he bought it? They'd need good security cam footage of what he was holding at the date and time that he checked out, but they at least could get the date and time off his receipt. But will that all cost more in manpower than the $20 bucks they lost? |

While I think that particular repack is an example of obvious theft any conscientious person ought to spot, I find it funny how we seemingly believe the average guy/gal working the service desk ought to know the figures have been switched, like it's common knowledge or something.
Newsflash, most people don't know, or give a shit, about every single Joe toy ever made...let alone the diff between o-ring & "ME." To them, toys is toys. We're geeks about this shit & we're a tiny minority. There's also the fact that retail employees are told to not argue with customers. Give 'em what they want, sort it out later...if ever. Shit, they can't even accuse a shoplifter swiping stuff right in front of them of stealing anymore. All they can do is call loss prevention & ask the crook if they require assistance. |

I mean what if they do catch a repacker.... say they set up a pinch where they observe him walking out with product X, then observe him walk back in the next day and return it with Y and Z components swapped out....What would they even be able to do? On what statute or complaint would they even be able to file charges?

The only realistic thing you can do is get that shit off their sales floor and inventory count so they're a little closer to reordering. Sucks though. Repackers are so low class.

They did buy it in the first place. And they are returning " something". Hmm. |

"I must have made a mistake when I repacked it to return, I have Gi Joe toys going back to the early 1980s and it is inventoried poorly, my mommy drank while she was pregnant, I paid my Lawyer 12 grand"
I mean we act surprised that the actual employees of the store cant tell the difference I bet there is no way a DA or prosecutor would notice or care.

People have already been brought up on charges for lots of kinds of return or sales fraud. Buying Playstations and returning them with rocks in the boxes, printing out cheap UPC stickers and putting them on expensive Lego sets to check out at a lower price, and taking stuff off the shelves and walking up to the return counter to return it without having purchased it first.
The essence is that you don't technically need to "steal" something in the old-fashioned sense for it to be an illegal form of theft or fraud. |
