These might be factory cast-offs, particularly given that they're loose samples. Of course, we laymen might not be able to notice anything wrong with the figures, but there are all kinds of reasons that figures potentially get tossed out.
Or they might have "fallen off a truck."
But regardless, Hasbro is probably producing the heck out of these things, and there'll be heavy stockpiles in the stores well ahead of the release date. Indeed, I would be deeply surprised if a few US retailers don't end up having some leak onto shelves well in advance of July 11th. Seems to happen with almost every "street date" line these days.
Additionally, I don't think "street dates" are actually illegal to break. Rather it's violating a contract between the retailer and the manufacturer that comes with automatic penalties (fines, etc...) attached. How strictly Hasbro enforces that is certainly up for debate, but it's not like the FBI or local cops are going to shut down the local Wal-Mart for selling G.I. Joe figures too early.

I guess everyones insight answers my questions and I understand about owning something first. I can see that...not to mention some people just have money to burn right! Still, for figures that IMO I think are pretty da** horrible...even if I was a millionaire there is no way I would buy this junk for some of those prices.

dtc and vvv had this same thing pop up. someone in the warehouse was dumpster diving getting the thrown away prototypes and selling them. its nothing new and as stated has been going on for a long time

Pretty normal stuff. Since this is the time frame of when production starts in order to manufacture the stock needed by June (they have to get much of it finished by then to fit within the time frame of shipping to distributors by July) these could be one of three things.
1) Pieces from sample runs that were sent to Hasbro for approval
2) Pieces from the first run of production (while they make sure everything is in working order on the line)
3) Pieces outright taken from normal production.

I get free stuff from my work all the time... usually when we produce things, there is always a few left over that wont fit in a case or pallet, so they are given away.
Maybe saying it was theft is a bit harsh...

Stuff I've bought from the infamous Chinese sellers tends to have some idiosyncracies, like paint defects or sharp flashes or sprues (I have a VvV Viper with a sharp piece of plastic coming off of its leg I could cut a throat with that I got from a Chinese seller). I assume the stuff is rejected by quality control and somebody has an arrangment to get it for cheap and then re-sell it.
Of course, as bad as Hasbro QC is now, I shudder to think what gets rejected now.
