Someone else picked up the trademark when Hasbro wasn't using it - you've only got five years before it expires if you're not using it.

Happens all the time with regular, every day use names.
In TF: Shockwave, Soundwave, Blaster, Bumblebee, Ratchet, etc. are all commonly used terms, and Hasbro has to constantly file for copyright, whereas "Optimus Prime" has no usage outside of specific reference to that character. In Joes it's the same thing: Flint, Duke, Beachhead, Scarlett, Dusty, etc. have to be updated and filed for copyright all the time. "Cobra Commander" and Destro and Zartan not so much, as they aren't common words. With "Water Moccasin", as a phrase, it is common and hard to file for copyright after it lapsed. Fun Fact: "Wraith" a few other characters and "Viper" aren't copyrighted. Nor are, in Transformers, Jazz, Ratchet, etc. That's why you see the names as "Autobot Jazz", "Autobot Ratchet", "Cobra Mercenary Wraith" and "Cobra Viper." The shorthand names for them aren't copyrighted. So really, none of this new. They could call him "G.I. Joe Soldier Shockwave", or Shockblast. Shockwave isn't available as a copyright-able name.

The Library of Congress registers copyrights which last for the life of the author plus 70 years. Trademarks, unlike patents, can be renewed forever as long as they are being used in commerce.
