i'm glad hasbro clarified this. they definately have a better respect for their customers than the music industry. then again, it takes more talent to do a custom than some dude downloading songs and burning cd's to pawn on the street.

i see it all makes sense now and i suppose if you were to make a cobra commander figure you would have to sell it as a "supreme leader custom" or maybe a custom figure inspired by cobra commander or something along those lines.

Secondly, some of those cards aren't even custom. They are reproductions of Hasbro material. Third, it doesn't need to be "an exact copy" to violate the law and constitute trademark infringement. Each of those "custom" cards sports Hasbro trademarks like the G.I. JOE logo, Hasbro logo, likenesses of protected characters, and names of protected characters. Quote:

Hasbro is making an effort to protect their own intellectual property by defending their trademark protection. It has nothing to do, one way or the other, with "people getting cheated". Unless, of course, by people, you mean Hasbro. Hasbro has trademark protection for the characters they created and own, but not for the concept of a military-themed 3¾" action figure in general. Using a character's name in an eBay auction title or description is not tantamount to packaging, marketing, and distributing counterfeit merchandise. The statement is pretty clear about what they will target, and no customizer is going wind up on their hit list for calling his custom Cobra Commander figure Cobra Commander in a solitary auction listing. when I tweak Duke's art and turn it into Starduster, like right here -- http://www.loserville.us/~gunslinger...tarduster.html -- I have done so using Hasbro's protected work. it doesn't belong to me, thus I cannot sell it, and especially can't do so with the Joe logo on it. if I do, and Hasbro allows it, I can contest their trademark of the G.I. Joe name and they can lose it. that is essentially what this is about. same with their images and reproduction of the figure parts. |

Thank you Destro. This really clears it up. You can sell a Cobra Commander custum on ebay. You can even say its Cobra Commander, from what I read. All you have to do is type in that this is a unique one of a kind custom figure. Simply by putting that you targetting what your doing and there fore in the clear. Which makes a lot of sense.
