So I walk into a comic store in Portland ME. I find 3 vintage figures I needed, ripcord, avac, and major altitude. So I go up to pay and notice a moray sitting behind the register. I asked if it happened to be for sale, the guy said he didnt know and saw that I was interested. He said 20. It missing the side guns both torpedoes and searchlight lens. So my dad bought it for my bday. We walk out and the owner walked in and was in shock uz it wasnt for sale. So I guess I got a deal.... Was it wrong to take it for 20, knowing its worth.... And knowing the guy is prob getting his @$$ whooped for it?

Nope congrats on your haul. Seems the owner should have educated his employees on the product a little better.

Good for you.
The guy was apparently anxious to make a sale and today you were the lucky person. And Happy Birthday! |

Nah, it's not like you talked the guy down or anything. You paid the asking price at that moment.

Legally speaking, when you saw the item and asked if it was for sale you were creating what's called in contract law an 'invitation to negotiate', the seller then gave you a quote ($20) which is known as an 'invitation to treat' or 'invitation to bargain' (in the US). You accepted the invitation and he accepted the agreed price for the agreed item. If he wasn't supposed to sell it, then that's on the owner not communicating with his staff properly. The fact that you knew it was worth more is also moot because in his 'invitation to treat' he also outlined the defects or items missing. It sucks for the owner but in no way should you feel bad. P.S. Happy Birthday! |

What store exactly?
There's Newberry Comics near the mall, but I'm not sure if that's still in existance. The sign on the building is down and it was dark in there on Saturday. |
