I would suggest being polite but stand firm that you should not have to pay for the return shipping. He should just refund the entire price to you and you should keep it in the box it came to you in, and just rewrite the return address on it. Tell him that you would like to avoid any reporting.
My question is why would he want it back if it's broken?
I had the same problem before as well. I recieved a Silverhawks figure MOC, but there was paint peeling off of the figure. I was clear and polite about the fact that there was no info about the paint chipping. He understood and refunded my money. No problems.
Only report him if it gets to be out of hand.

that is what i am trying to do i even took pictures just so he would see that i was not lying with items still in box. he just wrote me back saying that it was not like that when he put it in and does not have a replacement figure. he is standing firm on that he does not take back items but will this time but i must pay for shipping. i paid $12 for the serpentoe and chariot. if i pay shipping with dc number thats $4-$5 so that would mean that the refund would only relly end up being $7. I dont think that is fair i never negged any body and have been an ebay member for years. I do think if he does not change his stance on the matter it will come down to that. also the dagger that was included is not the originel dagger it is from some other toy line alltogether. I am just not very happy. the one nice thing was the chariot is complete and in very good shape.

evidently he is able to pay for other auctions, but has not paid for 7 different auctions. I hadn't blocked him after starting 5 cases against him on Jan 10, which allowed him to purchase 2 more items. I thought..."oh, maybe he just wants to save on shipping." No response to any messages for over 1 month. I now have 7 unpaid item claims against him and have him blocked.

Block tmed3023, Tyler Medeiros from Utah. He bought an item from me(91 Dusty) and he said that the backpack peg was broke(showed pic) and the pieces were in the bag. I felt bad but this does happen as it is 25+year old plastic we all know that. So he was interested in another figure I had. I offered to send that figure at a Total cost of $2.79 and threw in some extra accessories for the trouble. I double wrapped the figure in bubble wrap, put it in a small jewelry ziplock baggie, did the same for the accessories in another baggie, and put them in a 5x9 bubble mailer. I also ALWAYS face the figure towards the label side of the package for that extra layer of protection. He paid Wed night I shipped next day and he received it today(sat) from Ohio to Utah. He claims damage AGAIN that the nose is scraped. Shows a blurry picture with a hole in the BACK of the envelope but did not show the inner baggie as I wanted to see what that looked like. He asked if it was damaged before it shipped as there was a hole and if I had a replacement. I said no, I checked it for any kind of damage before I shipped it. Well he wants $2 refund. I told him that I do NOT give partial refunds and that if it was shipping damage to contact the Post Office and file a claim. Well he did not want to go through the hassle of that and wants me to give him a partial refund or he will file a claim against me. We sent several message back and forth and I contacted Ebay about it. They agreed with me as the Post Office should be liable for shipping damage and at least pay him the shipping which is how much he wants anyways. I also noted that if you look at his feedback left for others he has a total feedback of 51 and in the last month has left 2 neutrals(1 for damage, 1 for buyer selling item after he didn't pay for a week) and 1 Negative for guess what-damage. He seems like a guy who likes to get cheaper stuff by filing damage claims. sure the Dusty backpack was broke but how do I know he didn't already have a broken backpack and was getting a replacement? That and the second pic of the figure was blurry and I could barely see the face let alone any "scaping" as he put it to the nose. I have only had 1 damaged figure while shipping since I've been selling and now he himself has had 2 in the last week? I told him he needed to contact HIS Post Office as they must have a lot of problems to have that many damaged items showing up in the last month. I would block him to avoid any problems you may have with him.

Hello all, i bought a ROC Cover Girl from seller mystuff-503
about a month ago and pay with a USPS money order.
He has 100% feedback so i decided to take a chance.
He told me -his last email- that he have received the payment the
other day and that i should be receiving the item later that week.
That was last week and still no CG.
He stop communications and change the configuration on the link
of the CG i bought in that i can no longer contact him
He now has the same CG for auction and other great stuff so
be careful with this seller amigos.

He sells gi joes too, so I actually got very lucky and eBay actually removed it (woah) due to malicious competitor and also feedback extortion. This guy has great items but he is as rude and immature as it gets, so...AVOID

This guy bought 6 MOC funskool items from me and once he got the items contacted me outside ebay through paypal email id and claimed the items were "not smelling right " and he cant give them to anyone and wanted me to refund 3/4 of the total he had paid for the item( i shipped it free), i assured him they were the real stuffs and asked him to return them and only then will i refund him, he said he wont return them and threatened me and left a negative feedback and then went ahead and listed the items he bought from me ("ones he said dint smell right") among his listings, Then i asked around and found out he was a master re sealer of everything and sells fake items.
And now he sells fake chinese moc joes as real ones and trys to sell gi joes, I m sure many other sellers were cheated by his false claims and so he could make a profit in his listings.

I sold a Joecon Crimson Asp to the user. My auction terms ask for payment within 48 hours of auction end.
The buyer sent me a message stating they intended to pay on the 4th after the auction ended.
4 days passed and the user still hadn't paid. After sending 2 more messages, a second invoice, and no payment. I was going to open a claim, when they finally paid. I shipped the item that same day.
Yesterday the user left me a negative feedback for "Bad communication, left email no response and seller had a bad attitude". I'll admit I sent a stern email asking for payment, but it wasn't vulgar or rude. Just outlined my payment policies, plain and simple.
I love eBay.
