A few weeks ago I spotted an auction on ebay which was for a large lot of G.I. Joe figures, vehicles, and accessories. The shipping and handling price was only $16 and some odd cents. There was one only picture which was a collage of 4 other picture which had been shrunk down. It was very difficult to make out exactly what you would be getting. As such many people were not bidding on the auction. I decided it looked like a good opportunity to win a large lot of stuff. I bid but was outbid in the end by a few bucks. Then a day or so later I noticed the auction was now being offered as a second change deal. According to the seller the buyer refused to pay shipping for "58 pounds". Apparently despite listing the shipping and handling as just $16 or so the seller expected the buyer to pay full shipping. I don't blame the buyer for refusing to pay. I asked the seller what the actual shipping would be and for some pictures of the figures I'd be getting. He told me what the shipping was and sent me multiple emails with multiple photos attached of the figures. I decided it looked like a good deal. However, the seller had already listed the auction again. He offered to end the auction early if I were to just make him an offer. I did not want to do anything outside of ebay though just in case I got screwed. I put in another bid and won the auction for $102.50 (plus shipping).
The guy mailed my stuff out in a timely fashion and was even good enough to tell me the shipping was $45 cheaper than what he had told me and was offering the money back. I had never had somebody good enough to offer a partial refund on shipping so I told him I'd just take $25 back instead of the full $45.
Well I got my package of stuff yesterday in the mail. As I was going through it I noticed many of the figures I had been really looking forward to were not there. I sent the guy as message asking him where they were. There was at least (according to my rough count 38 figures missing as well as a Thunder Machine. These figures included the likes of 2 Hooded Cobra Commanders (I recieved1), 1 Battle Helmet Cobra Commander, a BAT, Viper, Destro, Snake-Eyes v2, Duke etc. Basically a lot of the more valuable figures from the early years. Well I get a message today from the seller and he says this:
Actually you did not read the revision on the listing, or contact me about it. This is what the revision said:
On May-26-09 at 21:51:09 PDT, seller added the following information:
"Please disregaurd the figures list as it has changed. There are a total of 50 figures, not including vehicle drivers. Dr. Minbender Prototype is still included, as is the Armor Cobra Comander. I deceided to keep about 50 figures. Most we 82-86. I can send anyone that asks for them updates of the figures.
Please do note that I did post that almost a full day before you put in your bid. Whick was:
hatta2k( 111) US $57.23 May-27-09 16:45:06 PDT"
Now I was never really paying attention to the figure list on the auction (as it was horribly incomplete anyway). I was paying more attention to the PHOTOGRAPHS HE SENT ME TELLING ME WHAT I WOULD BE GETTING. I still have those emails/photos.
So I ask you: Who is in the wrong here? Am I wrong in wanting those figures and the vehicle because the guy revised the auction before I bid to explain he was keeping half the valuable/sought after stuff? Or is the seller in the wrong for sending me pictures of what I was supposed to get without then sending me an email explaining that he had revised the auction?
I should note that the pic for the auction still shows the stuff (though difficult to see). I can clearly see the 3 hooded Cobra Commanders etc.

I really feel screwed here. It doesn't seem right that when asked for photos of what a person would get if they bid on your auction you'd then turn around and revise the auction so that many of the things in the photos were no longer part of the deal.

Who would include pictures of stuff you're not selling?
What's the sellers name so can avoid him?
Sadly, it's part you and mostly him. He shouldn't have given/sent pictures that included stuff he wasn't selling.
Sounds like the guy was trying to scam and get more money for crap stuff.
I wouldn't have had anything to do with him after the whole shipping thing with the first buyer. If the auction is listed with shipping at $16, then that's what shipping should be. No questions, no comments, nothing. Don't list a specific shipping if not sure it can be shipped for that.
I always factor shipping into my bid prices. I have a max I'm willing to go and that includes the shipping. So if shipping is $5 bucks and my max for an item is 15, my max bid will be 10.

Sorry man, i think he screwed you good but he covered his ass. you can try doing a claim with paypal but if it's that much stuff and that much $ to ship, it would be counterproductive to pursue it. if it were me, i would leave him negative feedback, and count it as a lesson learned.

I think what he did was very shady, offering pics of things he want actually selling, and instead of actully updating that list, just said "it's changed". That said, he did cover his ass on it, although I think what he did was very close to a scam. I really do not know what options you really have at this point, but I would have avoided this, as a lot is not clear on it (probably the whole reason he did it).

Unless the pics he sent you were in the NEW e-bay listing, you can't claim that's what he was trying to sell.
The offer he was trying to make with you outside of e-bay should have included everything in the pictures he sent you.
However, if you didn't clarify with him beforehand that the new listing included everything in the pictures he sent you and you didn't read the new listing, I don't think you can totally blame him.
Should he have clarified with you what the new listing was for especially since he was trying to make another deal with you that included more? YES!!
But since he refunded you your shipping, I don't think it was intentional on his part to rip you off and I don't think it was intentional on your part.
I think this was an unfortunate misunderstanding where neither side fully clarified what the NEW Listing was for.
If I were you I would try to work out a new agreement with him on the rest of the stuff and see if he would be willing to break a deal with you.
I don't think e-bay will do anything for you though since he changed the new listing.
That really sucks and I would be upset too, but I don't think he did this intentionally.

#1 get your $20 back from the shipping charges. No need for you to be mr nice guy and let him keep it. Hate to say it but you got screwed. He did cover his ass so you're up shits creek. Ebay will back him not you. I feel your pain brother. Did you at least got some stuff in the lot that makes you happy?

eBay is tricky and there is always some jokers trying to pull a fast one on somebody.
He sent you the pics of the full lot in order to get you to offer some $. You did not and decided to bid on the stuff on ebay to see if you can win it for cheaper (smart move).
But you failed to check the description and based your bidding on pictures that show some of the content not offerred. The seller did revise it so the way I see it is your fault.
I learned my lesson awhile ago too when I based my decision to bid on something because of a picture without asking any questions.

No doubt this seller is shady, but technically, he's in the clear. It sounds to me like he had an auction, you lost, he second chanced it and sent you pictures of what he was selling, then he decided to relist and change what he was selling.
You won the relisted auction so technically all the pictures he emailed you are null and void.
I don't think there's anything you can do here, especially with the updated info in the auction. Is it fair? Not really, but there isn't much to be done about it either.
On a side note, we all get expensive lessions during our lifetime. I've learned before that you have to read all the description and ask questions with some sellers (I've also learned that sometimes it really is too good to be true)

my 2 cents...
file a dispute with paypal, indicating that what you got was significantly different than what was offered. hang on to your emails with the pics he sent as proof. then go through the motions with paypal and state your case. if you can, print out or somehow save the auction page that shows the pics that show all you should've got (if he used ebay for his pics, that'll be a plus, as they're embedded in the auction and you can just send paypal a link to it). doing this will at least put him in an annoying situation that he'll have to deal with, as well as put his cash in limbo for a time. and it might get you a partial refund or the rest of what you thought you were getting. hopefully you haven't left feedback, so if things don't go good with the dispute, you can at least leave him a big fat neg. good luck!
