So I purchased this item:
eBay It was for the 15th anniversary cobar three pack. The price was really good (only $20) for what was advertised - mint, never opened. But when I got it, I found the bottom and sides unsealed. I double checked to listing to make sure that I did not miss anything. THen I emailed the seller, telling them that they falsely advertised. I got this response. "I beg to differ on my description of the item, but I will still offer you a full refund when you send the item back to me. If you know anyhting of the history of the GI JOE 15th anniversary products, you'll know (or can easily find out) that the adheasive used on the packaging was very poor as well as the plastics used. Many packages stored -- even those stored in the ultimate of conditons fell to the infereior production methods used by Hasbro. I had no intention of flase advetising. The items were indeed mint on the card and never removed. It wss never opened. I will grant you that I could have added all the details I just mentioned and probably should have, so it's just my luck that I sold it to you, a buyer who wasn't aware of the era of GI JOE in which he was buying under. Anywya, my mistake and I truly apologize." Now, i've been buying joes for a while now. Was I wrong to assume that mint, never opened meant that the item should be sealed? IF I return the item, i'll be out $15 for the s&h, since it's not included in the refund. SHould I leave negative feedback? |

Both of you were in the wrong.
You should asked even tho there was description and he should listed all the details of what was wrong with the package. I would keep those things and neg his butt for not describing his items fully.

He offered a refund... and your out S and H? True he should have been the one to add all the details.. people make mistakes but if your bidding on something you should always do some 'research' or ask questions. its your responsibility as a buyer just as much as is it is (as a seller) to list any defects the item may have He is offering a refund.. which even if he gives to you he still has to pay the listing fee and the transaction feez.. If i was you i would try to just keep it and renegotiate the price.. or some type of discount. |

those 15th anniversary guys were pretty cheap though. the o-rings snapped after a week on all of the guys i bought.

The seller lied (and admitted as much in his e-mail) when he said it was mint packaging and unopened. If you know anything about action figure collection, you'll know (or can easily find out) that "mint" means mint.
Even if the package opened up all by itself, it still is no longer mint, and no longer unopened. He lied in the description, and you should neg his ass to keep others from making the same mistake you did. Because he lied, he should be responsible for a full refund including what you paid for shipping to you as well as shipping of the item back to him. Anything less and he deserves a negative left. It's not the buyers responsibility to "list any defects"... first of all thats not possible, and second, the seller listed clearly that the item was "mint on card" and not opened, which is false - whether the seller or nature itself and mother time opened the package, the fact of the matter is, the package was not sealed. The fees the seller is stuck with are his own fault for falsely advertising what he was selling. Quote:

I don't think the guy lied at all. If you have been around for a few years you will find out that it is a common problem with those figures back then becoming opened by themselves. He states that it was sealed. (It probably was when he sent it) Sounds like the glue finally gave away and it opened in the mail. I have had this happen before. My dad sent me a Star Wars figure from 1995 or so. It was sealed when he sent it and when I got it, the bubble had slid off the card. I don't think my dad was trying to scam me.
Sounds like fate dealt you a blow man, but at least you were dealing with a responsible seller who offered you a refund, most people would have stated the history and told you to screw off or they could have started blaming you and saying you opened it and now want your money back. (These are just worst case scenarios though) |

Tell him to pay for the return shipping.
You shouldn't be out 1 dime cause he conveniently left out the true condition. Otherwise keep it/sell it & leave appropriate feedback.

I completely agree with Shogi, just keep it and deal with the loss. I wouldn't neg the guy, he did offer a refund and an explination. I would see if he would be willing to offer a partial refund for the inconvinence and ommision of the info. At the price you paid you are not really out for that much anyway.

These are good points guys. The main question is if the package was unsealed when the seller mailed it to me. It is completely conceivable that it was sealed when it was mailed, then popped open in the mailbox. I find this extremely hard to believe (though the product is ten years old), as half of the plastic is off of the card and the seller was selling it as buy it now for so cheap. In a followup email, the seller told me the item was listed 5x and not purchased, and he/she "got lazy" and did not include all of the details in this final listing. At no point has the seller said that item was sealed and then became unsealed during the shipping process.
I guess I have to be more thorough on my ebay bidding, but I figure "mint" and "never opened" are pretty self explanatory and don't require much clarification. The seller has been quite understanding and has offered to give me a complete refund, including all shipping costs. We just don't see eye to eye on the veracity of the listing. I'm probably gonna return the item and leave no feedback. |
