he wants 30 extra dollars. can they do that? what are the rules and ramifications?

If he files the non payer thingy eBay will ask you if it was mutual, if you say yes then he pays no fees, if you say no, fees are like BING automatic.

You'll still get an email from ebay when he tries to recoup his seller fees. That's when you stick it to him by saying it wasn't mutual and he gets charged those fees and can't get them back.

If you paid him through Paypal, don't even worry. You have 60 days before refunds are no longer allowed. If you file a claim and he cannot PROVE that you got the item you paid for (the only proof is a delivery confirmation #/Tracking #), your money will be returned regardless. I don't know about what fines eBay will charge him with, but they usually restrict your account from selling while they investigate.

I've read several forums regarding this, and other victim's report that ebay's response is not so great. I would just let him relist it and find another. The feedback on ebay is no longer what it used to be either, so I wouldn't bother with that either. Just save your money, you will find another from a honest dealer I'm sure.

Tell them you won this item, paid for this item and now the seller wants an extra $30.00 above the cost of the auction and shipping.
The seller is required to sell the item for what the auction ends at and the stated shipping. Now Ebay will shake his tree but in the end the worst that will happen is he will get suspended or banned. If you paid via paypal you are protected. All you have to do on Paypal is open a case there too and request a refund.

after reading his emails he is probably not exaggerating too much. If you raise too much of a stink with ebay and don't pay his extortion fee then he will probably break pieces out of spite. The 2 options I see are pay the extra $30 or request a refund.
I hear tankers tell all of their ebay horror stories and I am at a loss. I have been buying and selling on ebay since 1999 and have never had a major issue. Good luck man

Well, first off I'm sorry the deal isn't working out for you cause I'm certainly familiar with ebay headache over the years. I will just say this though, I have a Terror Drome (in better condition than the one being sold here) that I have been looking to get $200 for, now I'm not really in a rush to sell which is why I haven't yet. Let me tell you though, that thing is a NIGHTMARE to ship. This is why I simply will not sell to someone if it is not a local transaction. In some cases it's too big to fit through a regular doorframe even without a shipping box around it! The ramparts are brittle and can snap easily, there are lots of small parts that can become loose. Honestly, just more headache than it's worth.

Of course, I side with you because the seller absolutely should've done their homework with an item of this size prior to listing it for sale, and I absolutely believe what they are trying to pull is unethical and against ebay rules, so I hope for your sake at the very least you get your money back.

That's the best response one could give CV. I applaud your patience! And above and beyond what most people would do.

I highly doubt that Ebay can force anyone to actually sell the item. People can change their mind for any reason at all. I know it's a "binding" contract but all that means is that you are obligated to pay if you win the auction, and they are obligated to ship the item or return your money.

I know what happened to you is probably shady, but I'm sure there are occaisions where the item might become damaged, lost or stolen before the seller gets a chance to ship it out to the winner and therefore must refund their money.

I guess they have every right to change their mind as well no matter what the reason is.

The shipping cost listed is part of the "contract" that he agreed to when he listed his item and you agreed to when you bought it.

Sounds like he's making it seem like he's trying to recover shipping cost. But truth is he didn't plan shipping well, like buying a boxes and packing material (which I usually recycle from old transactions or take from what work would just throw away...and transfer those savings to my buyers.) his posted s&h should have had this in mind. As a seller I've personally had to bite the bullet before and pay out of pocket, because shipping ended up costing more than I quoted. I usually price s&h high and just refund the difference if I end up getting it ship for cheaper. Which most buyer's appreciate. Ask for your money back and keep shopping.

shipping is always a hasstle when dealing with big toys.

i can say i havnt bought anything from ebay since 2001 and i can say i know better than to sell on ebay.

all my toys aquired over the internet have all been threw the tank with very little problems.

Why would paying in pennies be a way of getting back it him? The only reason why I say that is there was a pizza tipping thread a while back and it seemed like a lot of people didn't think it was a big deal to pay in pennies. :D

I hope this works out for you man, If it was me I would have retracted my bid and let him repost the thing. Big toys can be a problem for shipping and ebay's shipping calculator is worth so much pile of dog shit, if you dont get the specifics of the item correct it quotes you too low or too high and UPS is always more than what you get paid for. Even on some 1-2lb packages Ive gotten burnt on shipping as a seller. The key is to not do what he did, get your bubble wrap and all your supplies ahead of time and factor those into the auction cost, and or handling fee. Im running a small business out of my house now and I cant stress enough how important it is to cover all the costs in your listing. Im apprehensive about the new taxing coming down the pipeline, but I look at it this way, people will still buy and it helps me have a provable paper trail if Im paying taxes, never want to get audited for selling customs action figures.

You know, I can totally understand why people are saying what theyre saying, but a the same time I would have communicated through ebay with the same type of messages you did.

Ive been buying an selling on ebay for like 12 years. I took a break from it when it "exploded" back around 2000, but overall I had a few people like this.

Some people are really weird. You have no idea whats going on in their mind and so far there is no reason to doubt the guy is being sincere. Give it time, let it play out, see what happens and then be calm, cool and collected if you NEED to file a claim.

By the sounds of it, you arent familiar with ebay. You dont know how to open a claim supposedly, but the guy says you did. Maybe you did, here is my point:

If the guy honestly miss-calculated shipping, he is going to get screwed. He probably wasnt planning on boxes, peanuts, bubblewrap, etc., and he probably just figured it was big, looked up shipping fees real quick or looked at other auctions fees. If thats the case and....

you accidentally opened a case against him/me, Id go ape-shit too. I am losing my shirt trying to sell and item to make a buck but it turns out to be a huge hassle, Im losing money and now the guy is trying to scam me out of my money. Thats what Id think. The guy might be a little off his rocker and/or a little clueless.

Either way, I wouldnt say its a scam until its all said and done. People operate differently and think differently than others.

When/if the package arrives, find out how much the shipping actually cost. Then see if its a brand new box, peanuts, bubble wrap, etc., and if it is and its exactly what you paid for, Id have no problem sending the guy more cash, but thats just me. Im sure Ill get flamed and people will say "Screw him, he said $50, its $50". Well, thats not how I was raised. Because someone makes an error you dont take them to the cleaners.

On the other hand, if it is a scam and it doesnt show or isnt what you bought, again, be calm cool and collected, DO NOT email him, just file the claim through ebay and Pay-Pal and let them sort it out. Youll get a refund, DONT FREAK. Dont send inappropriate emails cursing him out. Dont send ANY messages to him. Just file the claim, give them the info and get your money back. Leave him negative feedbacks thats appropriate, not douchy, and move past it.

Thats the best way to handle the entire situation.

If he miscalculated shipping, that's his fault. This is how I look at it: I've bought stuff from tankers where they miscalculate shipping and I send them extra money since they're tankers.

On Ebay, however, I have been screwed over by sellers who charge me for higher than necessary shipping costs to cover their losses on the items, but I take it and deal with it as is. So if someone on Ebay miscalculates shipping, it's on them. Don't quote someone anything if you aren't sure. An extra trip to the post office with the item already packaged is a small price to pay for not being hassled later.

funny and scary as hell. the bottom of the box was full of peanuts and the terror drome was sitting in them and had them just about covering the top of the drome (it was on its side). but the top of the box had a few scraps of newspaper thrown in and a huge gap between the drome and the roof of the box. that ass is soooooo lucky ups obviously never turned the box on its side or upside down or all hell woulda broken loose inside that box.
